NoBTHEN BLUE, L.L.P. <br />Mr. John Link <br />January 28, 1998 <br />Page 2 <br />35 <br />plat at Plat Book 78, Page 28 includes the dedication and acceptance of a public road right <br />of way. <br />Key West, which has conveyed no lots in the subdivision, is in a position to assure that the <br />utility company and the homeowners association will convey and release their interests in the <br />easements and common areas if the Commissioners are willing to revoke their approval of the <br />subdivision plats and release the conservation easement such that the title of the property would <br />be returned to the same state it was in prior to the approval of the subdivision. Key West <br />recognizes that it would lose any rights it might have to develop the property under the <br />application it submitted for University Manor if the Commissioners grant this request and that any <br />subsequent development of the property would be under the ordinance as it might exist at the time <br />the subsequent application is made. <br />Time is an issue since Key West has until April 1 to obtain the revocation of the existing <br />approval. If the revocation cannot be obtained by that time, Key West would lose its sale and <br />would submit a final plat for the balance of Phase 1. <br />Please let me know how we should proceed from here. <br />Sincerely, <br />David M.
