continue to be responsible for monitoring the condition of the protected area and <br />enforcing the terms of the Conservation Easement. Furthermore, keeping the <br />Conservation Easement does not have to be a permanent decision. It may be <br />abandoned or transferred in the future. <br />The Conservation Easement does not abut a public right -of -way. However, the <br />Conservation Easement includes the County's right to cross other lands owned by <br />the Grantor and its successors for the purpose of monitoring the protected area. <br />The request for revocation was discussed by the Board of Commissioners on <br />February 17. A question was asked about the Stoney Creek Basin Small Area Plan <br />designation for the property. The SCBSAP indicates that the area of University <br />Manor is to be considered as "Lower Intensity Development Area." Accordingly, <br />an overlay zoning district was created on June 2, 1997, to modify the flexible <br />development regulations to eliminate the bonus units and the village option, and to <br />exclude active recreation area from open space calculations. <br />Draft documents are attached to accomplish revocation of the subdivision approval <br />and abandonment of the public roads. Two versions of the resolution are included, <br />one of which releases the Conservation Easement (Resolution B), and the other <br />retains it (Resolution A). <br />RECOMMENDATION: The Administration recommends the following: <br />1. Adoption of attached Resolution A to revoke the subdivision approval <br />of University Manor, Phase I, and close the existing public roads in <br />Section I (retains the Conservation Easement); and <br />2. Scheduling of the public hearing to close the roads for the regular Board <br />of Commissioners meeting on either April 21, or May 6, 1998. <br />
