Phase I consists of 47 single - family <br />residential lots served by new public roads, individual septic systems, and a <br />community water system. The Final Plat of Phase I, Section I was approved and <br />recorded on April 16, 1997. Section I contained nine (9) lots and approximately 24 <br />acres of open space. Part of the open space (8.4 acres) was included in a <br />Conservation Easement dedicated to Orange County and accepted by the Board of <br />Commissioners on December 17, 1996. <br />The roads and water system in Section I were completed and approved by <br />appropriate authorities. The road rights -of -way were accepted, without <br />maintenance responsibility, by Orange County on behalf of the public with <br />approval of the Final Plat. The developer has not requested that NCDOT take over <br />maintenance of the roads because the State's minimum density requirements have <br />not been satisfied. No lots have been sold and no building permits issued in <br />Section I. <br />The roads in Section II of Phase I have been partially graded and graveled, but not <br />completed. The Final Plat of Section II has not been submitted, but could be prior <br />
