96R <br /> 4 . <br /> 5. Use of Available Flood Data. The final rule revises the <br /> requirement at §60 .3(b) (4 ) that communities obtain, review, and <br /> reasonably utilize base flood data available from any source to <br /> regulate construction in Zone A. If your community has flood <br /> hazard areas which are designated as 2one'A or could annex such <br /> areas, you must revise your ordinance to include the fo?1.0wing <br /> or its equivalent: <br /> The (local administrator) shall obtain, review <br /> and reasonably utilize any base flood elevation <br /> and floodway data available from a Federal, <br /> State, or other source, as criteria for <br /> requiring that new .construction, substantial <br /> improvements; or other development in 2 one. A _ <br /> (reference provisions of your ordinance which <br /> meet 960 .3(c) (2) , (3) , (5) and (6) and (d ) (3)j . <br /> Note that available base flood data include data submitted with <br /> subdivision proposals and other proposed developmen't-s greater than <br /> 50 lots or 5 acres, whichever is less , including manufactured home <br /> parks and subdivisions (see §60.3(b) (3) 1 . <br /> 6. Elevation Certification. Current NFIP criteria require that <br /> communities obtain and maintain on file the elevation of the <br /> lowest floor (including basement) of new and substantially <br /> improved structures in all special flood hazard areas. The <br /> final rule removes this requirement in Zone A except in those <br /> instances where base flood elevation data from other sources are <br /> utilized (e.g. , as provided for in §60. 3(b) (41 of NFIP criter- <br /> ia] . You may modify your ordinance accordingly.. Please be <br /> aware that substantially lower flood insurance rates are <br /> available for individuals that construct to these other available <br /> base flood elevations and submit elevation certificates as part <br /> of their flood insurance applications . You must continue to <br /> obtain lowest floor elevations in all special flood hazard <br /> areas other than Zone A. <br /> 7. Functionally Dependent Uses - The final rule adds a special <br /> provision regarding the issuance of variances for functionally <br /> dependent uses. You are not required to make this change and <br /> should do so only if your community has navigable waterways <br /> and has encountered difficulties in applying NF31", criteria to <br /> these uses. To make this change, add the definition of 'func- <br /> tionally dependent use" in the final . rule to the definitions <br /> sections of your ordinance. Also add the variance provision at <br /> §60. 6(a) (7 ) of the final -rule to the variance vz-ov is ions in your <br /> ordinance. <br />
