THE STATE OF NORTH CAROLINA <br />COUNTY OF ORANGE <br />KNOW ALL BY THESE PRESENT <br />INTERLOCAL AGREEMENT <br />BETWEEN THE TOWN OF CHAPEL HILL, NC AND COUNTY OF ORANGE, NC <br />2010 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This Agreement is made and entered into this day of u 2.. , 2010, by and <br />between The COUNTY of Orange, acting by and through its goveming body, the <br />Orange County Board of Commissioners, hereinafter referred to as COUNTY, and the <br />TOWN of Chapel Hill, acting by and through its governing body, the Town Council, <br />hereinafter referred to as TOWN, both of Orange County, State of North Carolina, <br />witnesseth: <br />WHEREAS, this Agreement is made under the authority of Sections 153A-14 and 160A- <br />17.1 of the North Carolina General Statutes; and <br />WHEREAS, each goveming body, in performing governmental functions or in paying for <br />the performance of governmental functions hereunder, shall make that performance or <br />those payments from current revenues legally available to that party; and <br />WHEREAS, each governing body finds that the performance of this Agreement is in the <br />best interest of both parties, that the undertaking will benefit the public, and that the <br />division of costs fairly compensates the performing party for the services or functions <br />under this agreement; and <br />WHEREAS, the COUNTY desires to serve as the fiscal agent and will file a single joint <br />application to apply for the awarding of the FY 2010 JAG funds in the amount of <br />$23,151.00; and <br />WHEREAS, the COUNTY requests that the TOWN provide the COUNTY $4,630 from <br />the JAG award; and <br />WHEREAS, the TOWN and COUNTY believe it to be in their best interest to reallocate <br />the remaining JAG funds. <br />
