MOZELLE J. PRATT ZONING CASE <br />(ASSESSMENT OF CIVIL PENALTIES) <br />PURPOSE: Consideration of assessment of civil penalties in the Mozelle J. Pratt <br />Zoning Case. <br />BACKGROUND: A number of complaints have been received between March 1996 and <br />May 1998 about storage of junked or wrecked motor vehicles and a <br />junked mobile home on the property of Mozelle J. Pratt property at 6808 <br />Rocky Ridge Road in Chapel Hill Township (Tax Map No. 7.21..24A). <br />Notifications of Zoning Violation were sent on April 7 and May 3, <br />1996, and on March 25 and April 9, 1998. <br />The use of the property is in violation of Section 4.3 Table of Permitrerl <br />Use. S50 Storage of Goods, Ot~rc~nnr and Section 6.16.7 Storage of <br />Junked or Wrecked Mo nr Vehicle of the Zoning Ordinance. Four <br />junked or wrecked motor vehicles, automotive parts lying on the ground, <br />a junked mobile home, and domestic waste are being stored outdoors on <br />the premises. The property is zoned RB Rural Buffer. Storage of goods <br />outdoors and of junked or wrecked motor vehicles are not permitted in <br />the RB zoning district. <br />Ms. Pratt was directed to accomplish the following on or before, May <br />11, 1998: <br />Remove the junked mobile home from the premises; <br />2. Remove the junked or wrecked motor vehicles from the <br />premises; and <br />3. Remove the domestic waste and household items stored outdoors. <br />If the directives were not completed on or before the above date, the <br />Zoning Enforcement Officer warned that a request would be made to the <br />Board of County Commissioners to assess civil penalties in the amount <br />of $100.00 per day beginning on Tuesday, May 12, 1998, until the <br />violations are corrected. Each day's continuing violation is a separate <br />and distinct offense. <br />Section 6.16.7 of the Zoning Ordinance states: <br />
