13 <br />(c) identify the respondent to whom the <br />withdrawal applies; <br />(d) contain the HUD case number and the~State or <br />local Agency case number; <br />(e) explain the reason(s), complainant wishes to <br />withdraw the complaint (see also VI.3 of this <br />criteria; <br />(f) contain a statement that there was no <br />coercion or`fear of retaliation from any <br />person (not just the respondent>; and <br />(g) inform the complainant(s) and respondent(s) <br />that the complainant may refile the complaint <br />if the terms of the settlement are 'not <br />satisfied where the discriminatory housing <br />practice has not exceeded the statutory <br />limitation of the State or local fair housing <br />law. <br />2. Documentation Required. The following <br />documentation should be mailed to HUD at the time <br />of reporting the closure to HUD: <br />(a) a chronology of Agency actions prior to the <br />withdrawal request; and <br />(b) a copy of the signed and dated withdrawal <br />request. <br />V. ADMINISTRATIVE CLOSURES - If over 20$ of the Agency's total <br />caseload are closures as discussed in A through D of this <br />section, the Agency is ineligible for SEE funds (reference <br />115.305(b)). <br />A. Withdrawals Without Resolution <br />1. Requirements for Acceptance. The withdrawal <br />request must: <br />(a) Be in writing; <br />(b) Be signed and dated by the complainant or an <br />authorized representative; <br />(c) Identify the respondent(s); <br />(d) Contain the HUD case number and the State or <br />local Agency case number; <br />
