12 <br />election and describe the remedies available <br />under each); <br />(c) a copy of the response to the notices <br />described in (b) above (if there is no <br />response, documentation should be included in <br />the case file); and <br />(d) a copy of the correspondence or other <br />documentation that reports on the failed <br />conciliation attempt(s) including pertinent <br />dates. <br />C. Cases Set for Administrative Proceedings, Civil Action, <br />or Judicial Review. <br />(1) Where the Agency's conciliation efforts are not <br />successful, the complaint must be set for <br />administrative or civil action, under the State or <br />local law. HUD shall accept the case for funding <br />support when the Agency provides documentation <br />which indicates the date of referral for such <br />legal action. <br />(2) The Agency will report the final decision of any <br />administrative hearing or civil proceeding to the <br />appropriate field office. If the Agency does <br />not provide this information within 30 days of the <br />final decision, the GTR, with the concurrence of <br />the CAO, may recapture up to 50$ of the payment. <br />IV. SETTLEMENT CLOSURE <br />If the complainant and respondent agree to settle the <br />complaint without the State or local Agency's involvement, <br />the complainant may wish .to withdraw the complaint. If the <br />complaint is resolved as a result of the complainant's <br />withdrawal, the GTR must review the terms and conditions of <br />the settlement to determine whether the following criteria <br />are satisfied. <br />Withdrawals with Resolution. A withdrawal with. <br />reso ution is ased only on the complainant's request <br />for withdrawal of a complaint because a resolution <br />has been agreed upon by the complainant and respondent. <br />1. Requirements for Acceptance. The withdrawal <br />request must: <br />(a) be in writing; <br />(b) be signed by the complainant, or authorized <br />representative, and dated; <br />
