In evaluating whether <br />conditions for filing a complaint have been met, <br />intake staff should consider whether the <br />information as provided addresses the following <br />elements: <br />(a) adequately informs the certified substantially <br />equivalent Agency about the allegations that must <br />be investigated and defended; or <br />(b) does not contains language that could <br />potentially detract from the allegations or <br />confuse the issues that need to be addressed. <br />Where it is determined that there is insufficient <br />information, the complainant ;s) must be notified <br />immediately (by the 5th day after receipt of the <br />complaint) and informed, both personally and in <br />writing, what information must be provided to <br />constitute the filing of a complaint. The <br />complainant should be advised that unless the <br />required informants received, no assistance can be <br />provided. If the required information is not <br />received no further action an the complaint is <br />necessary. <br />5. The complaint may be filed with the assistance of <br />an authorized representative of the person filing <br />the complaint. <br />The State or local Agency is required to refer <br />complaints or provide information to HUD regarding <br />allegations which the Agency receives involving a <br />practice which is not covered by the State or <br />local law, but is covered by the Federal Fair <br />Housing Act. (See Sections VII and VIII of the <br />written agreement between the Agency and HUD.) <br />B. Dual-filed~Complaints - only dual-filed complaints are <br />considered~or payment under tf-e FHAP. <br />1. A dual-filed complaint is one that has been - <br />docketed by both HUD and the Agency. <br />2. Complaints filed first with a State or local <br />Agency, and those received by HUD and subsequently <br />referred to a certified or interim certified <br />Agency, are considered dual-filed with the Agency <br />under its own law and with HUD under the Federal <br />Fair Housing Act. <br />3. In order to preserve the statutory period for <br />filing complaints, a complainant may provide <br />information to be contained in a complaint by <br />
