Z-4-98 James and Patricia LaTorre <br />The property is located south of Interstate-85 on the north side of West Ten Road (SR <br />1144), approximately 0.5 mile west of Bushy Cook Road (SR 1137) and approximately 1.25 <br />miles east of Buckhorn Road (SR 1114) and is referenced as lot 2A on Tax Map 44, Cheeks <br />Township. The applicants propose to rezone a 19.96-acre lot from Primary Economic <br />Development to Secondary Economic Development. <br />ZONING ORDINANCE TEXT AMENDMENTS <br />Cane Creek Watershed Overlay Districts <br />Changes are proposed to the Zoning Ordinance to implement new watershed protection <br />measures for Cane Creek watershed in southwestern Orange County. Three alternative <br />management options have been identified for consideration, which would alter either the <br />minimum lot size and the amount of open space in new major subdivision developments; or <br />keep the existing minimum lot size and require new major subdivision developments to set <br />aside a percentage of land as open space. Amendments to implement these management <br />options would amend a definition in the ordinance and change the existing protected watershed <br />(CANE-PW) and critical area (CANE-CA) overlay districts for Cane Creek, depending on the <br />management option selected. These sections would include Section 2.2 (Definitions) and <br />Section 6.23 (Extra Requirements for Watershed Protection Overlay Districts). The changes to <br />the definitions section would reflect special standards for Flexible Development in the <br />watershed, which vary depending on the option selected. The changes to the overlay districts <br />would apply a minimum lot size of five acres in the watershed, and allow for up to five lots as <br />small as two acres in size for lots of record, if this management option is selected. <br />SUBDIVISION ORDINANCE TEXT AMENDMENTS <br />Flexible Development in Cane Creek Watershed <br />Changes are proposed to the Flexible Development section of the Subdivision Regulations to <br />implement new watershed protection measures for Cane Creek watershed. Three alternative <br />management options have been identified for consideration, two of which would alter either the <br />amount of open space in new major subdivision developments, or require new major <br />subdivision developments to set aside a higher percentage of land as open space. The third <br />management option would keep the existing standards of this section, but require new major <br />subdivision developments to utilize the Flexible Development approach. Specifically, these <br />amendments to Section IV.B.10 of the Subdivision Regulations would amend the definition of <br />Flexible Development to recognize special standards in Cane Creek watershed. Minimum open <br />space requirements may need to be amended for Cane Creek watershed, as two management <br />options call for requiring that 50% of the tract is maintained as permanent open space as <br />specified in this section. These amendments are proposed in conjunction with proposed <br />changes to the Zoning Ordinance to reflect new watershed protection recommendations. <br />All interested citizens are invited to attend this hearing and be heard.
