The third management option would keep the existing <br />standards of this section, but require new major subdivision <br />developments to utilize the Flexible Development approach. <br />Specifically, these amendments to Section IV.B.10 of the Subdivision <br />Regulations would amend the definition of Flexible Development to <br />recognize special standards in Cane Creek watershed. Minimum open <br />space requirements may need to be amended for Cane Creek <br />watershed, as two management options call for requiring that 50% of <br />the tract is maintained as permanent open space as specified in this <br />section. These amendments are proposed in conjunction with proposed <br />changes to the Zoning Ordinance to reflect new watershed protection <br />recommendations. <br />ORANGE COUNTY ZONING ATLAS AMENDMENTS <br />1. Z-5-98 L. J. Rogers Trucking Co. <br />The Orange County Planning staff requests that a 3.44 acre parcel, <br />identified by Orange County Tax Map 2.17..1 C and a 0.94-acre portion of <br />a lot identified by Orange County Tax Map 2.17..1 be rezoned, <br />respectively, from AR Agricultural-Residential and NC-2 Neighbofiood <br />Commercial to EC-5 Existing Commercial to correct an error in the initial <br />zoning of Cedar Grove Township. The property is located on the <br />northwest side of N.C. Highway 49 approximately 1,000 feet southwest of <br />the intersection of N.C. 49 and Corbett Ridge/Carr Store Road (SR 1004). <br />L. J. Rogers has operated L.J. Rogers Trucking Company on these <br />properties since 1975, prior to the adoption in 1981 of the Land Use <br />Element of the Comprehensive Plan and prior to the adoption of zoning in <br />Cedar Grove Township in 1994. <br />The Land Use Element of the Comprehensive Plan designates the area <br />within aone-half mile radius surrounding the intersection of N.C. 49 and <br />Corbett Ridge Road/Carr Store Road as a Rural Community Activity <br />Node. The Plan identifies the LC-1 Local Commercial and NC-2 <br />Neighborhood Commercial Zoning Districts as appropriate for a Rural <br />Community Activity Node. In that Mr. Rogers existing business does not <br />fit into either the LC-1 or NC-2 Zoning District, the EC-5 Existing <br />Commercial Zoning District should have been applied at the time of initial <br />zoning. <br />2. Z-3-98 Lawrence Park Subdivision <br />This request for rezoning is being made in conjunction with PD-3-98, a <br />proposal for rezoning 83.32 acres as a planned residential development.
