~~ 3 <br />and Special ~'se Permit. <br />Provided the Planning Board and County Commissioners frnd in the affirmative on <br />the general standards, the Zoning Officer recommends approval of the request for a <br />Rezoning, Planned Development,and Special Use Permit for Lawrence Park <br />subject to the following conditions: <br />1. Existing and proposed vegetation shall be installed and/or maintained as <br />indicated on the Landscape plan. <br />2. The submitted draft homeowners association documents and restrictive <br />covenants to address use and maintenance of the recreation and open space <br />areas shall be reviewed and approved by the County Attorney. <br />3. Security shall be submitted by the applicant and approved by the County <br />Attorney guaranteeing the construction of all improvements. Security may be <br />posted on a Phase by Phase basis however, all improvements in each phase <br />must be completed before construction may begin on a new phase. The <br />amount of the security shall be 110 percent of the estimate. <br />4. Water and Sewer improvements shall be constructed to Town of Hillsborough <br />standards. <br />~. All road improvements shall be constructed to NCDOT standards. <br />Improvements proposed for Lawrence Road shall be constructed in Phase <br />One. Improvements proposed for US 70A shall be constructed in Phase Two. <br />The extension of Lori Drive shall be constructed from Dunston Way to Lannie <br />Drive in Phase Three. <br />6. The Special Use Permit will automatically expire within 12 months from the <br />date of approval if the use has not commenced or construction has not <br />commenced or proceeded unless a timely application for extension of this time <br />limit is approved by the Board of County Commissioners as provided in <br />8.4.11 of the Orange County Zoning Ordinance. <br />7. If any condition of this Special Use Permit shall be held invalid or void, then <br />this Special Use Permit shall be void in its entirety and of no effect. <br />No decision on the application is made by either the Planning Board or the Board of <br />Commissioners at the public hearing. Instead, the Planning Board has 60 days <br />within which to prepare and submit a recommendation to the Board of <br />Commissioners. Failure of the Planning Board to submit a recommendation within <br />the required time shall be considered a favorable recommendation, without <br />conditions. <br />
