leased asset, and assure that the Lessee will use the Project asset to provide mass <br />transportation service, either through a "Lease and Supervisory Agreement" between the <br />Contractor and Lessee, or another similar document. The Contractor agrees to provide a <br />copy of any relevant documents. <br />b. Contractors Primary Responsibility to Comply with Federal and State <br />Requirements. Comptroller General of the United States: The Contractor agrees to <br />provide the NCDOT, the FTA, Administrator, the Comptroller General of the United States <br />or any of their authorized representatives access to any books, documents, papers and <br />records of the Contractor which are directly pertinent to this Agreement for the purposes <br />of making audits, examinations, excerpts and transcriptions. The Contractor agrees to <br />provide the U.S. Comptroller General and his representatives with the authority and rights <br />as provided under Section 902 of the ARRA not limited to: <br />c. Authority of the Inspector General: The Contractor agrees in accordance with <br />Section 1515(a) of the ARRA to provide representatives of the Inspector General to <br />examine any records or interview any employee or officers working on this contract. The <br />contractor is advised that representatives of the inspector general have the authority to <br />examine any record and interview any employee or officer of the contractor, its <br />subcontractors or other firms working on this contract. Section 1515(b) further provides <br />that nothing in this section shall be interpreted to limit or restrict in any way any existing <br />authority of an inspector general. <br />(1) Examination of any records of the contractor or any of its subcontractors, or any <br />State or local agency administering such contract, that directly pertain to, and <br />involve transactions relating to, the contract or subcontract; and <br />(2) Interviewing of any officer or employee of the contractor or any of its <br />subcontractors, or of any State or local government agency administering the <br />contract, regarding such transactions. <br />d. Financial 8~ Technical Capacity. The Contractor agrees to maintain sufficient legal, <br />financial, technical, and managerial capability to: <br />(1) Plan, manage, and complete the Project and provide for the use of Project <br />property; <br />(2) Carry out the safety and security aspects of the Project; and <br />(3) Comply with the terms of this agreement, the Master Agreement between the FTA <br />and the Department, the Approved Project Budget, the Project schedules, the <br />Contractors annual Certifications and Assurances to the Department, and <br />applicable Federal and State laws, regulations, and directives. <br />e. Administrative Requirements.
