<br />~ . <br />-Please return this copy to -~ 5~,~ <br />Clerk to the Board's office for PAP 5w <br />STATE OF NORTH CAROLINA NONURBANIZED AREA <br />COUNTY OF WAKE PUBLIC TRANSPORTATION <br />GRANT AGREEMENT FOR <br />PUBLIC BODY ORGANIZATIONS <br />NORTH CAROLINA COMMUNITY TRANSPORTATION <br />DEPARTMENT OF TRANSPORTATION PROGRAM - ARRA <br />And CFDA NUMBER: 20.509 <br />ORANGE COUNTY PROJECT NUMBER: 10-AR-056 <br />THIS AGREEMENT made this the~day of 1~~~ 20~~hereinafter referred to <br />as AGREEMENT) by and between the NORTH CAROLINA DEPARTMENT OF <br />~~ ~~ <br />TRANSPORTATION (hereinafter referred to as Department , an agency of the State of <br />North Carolina) and ORANGE COUNTY, (acting in its capacity as the designated <br />American Recovery and Reinvestment Act grant recipient hereinafter referred to as the <br />"Contractor"). <br />WHEREAS, the purpose of 49 U.S.C. 5311 is to enhance access of people in non- <br />urbanized areas for purposes such as health care, shopping, education, recreation, public <br />services, and employment by encouraging the maintenance, development, improvement, <br />and use of public passenger transportation systems; and <br />WHEREAS, the American Recovery and Reinvestment Act (hereinafter referred to <br />as ARRA) of 2009, (Pub. L. 111-5, 2009 H.R. 1), was signed into law by President Barack <br />Obama on February 17, 2009, and provides $8.4 billion for transit capital improvements; <br />WHEREAS, ARRA includes a total of $103 M in North Carolina transportation <br />funding, of which $33,055,500 is for non-urbanized area projects; <br />WHEREAS, ARRA transportation goals are to preserve and create jobs and <br />promote economic recovery; provide federal investments in transportation infrastructure <br />and transit capital improvement to stimulate jobs, protect the environment and support <br />infrastructure projects that encourage long-term economic benefits; <br />WHEREAS, on June 4, 2009, the North Carolina Board of Transportation approved <br />the 5311 ARRA program of projects and authorized funds for these transportation projects <br />as set forth in the Contractor's application and the approved Project budget; <br />WHEREAS, the Federal Transportation Administration on August 26, 2009 <br />awarded ARRA funds to Department with the understanding that such funds will be used <br />for designated projects pursuant to this Agreement for the purposes specified in Appendix <br />A, attached hereto and incorporated herein by this reference. <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes <br />(N.C.G.S.) designates the Department of Transportation as the agency of the State of <br />North Carolina responsible for administering all Federal and/or State programs relating to <br />public transportation, and granted the Department authority to do all things required under <br />applicable Federal and/or State legislation to properly administer the public transportation <br />Revised 1/6/10 <br />
