5.1.3 Payment of Additional Compensation <br />The CMAR shall submit invoices for additional compensation <br />with its invoice for Services and payment shall be made <br />pursuant to the provisions of Article 7 of this Agreement. <br />ARTICLE 6 <br />OWNER'S RESPONSIBILITIES <br />6.1 Program <br />The Owner shall provide to the CMAR complete information <br />regarding the Owner's requirements for the Project. <br />6.2 Decisions <br />The Owner shall examine information submitted by the CMAR <br />and shall render decisions thereto promptly. <br />6.3 Insurance <br />The Owner shall furnish the insurance that the Owner has <br />agreed to furnish as specified in Article 8. <br />6.4 Notice of Nonconformities <br />If the Owner observes or otherwise becomes aware of any fault <br />or defect in the Project or nonconformity with the Contract <br />Documents, the Owner shall give prompt written notice thereof <br />to the CMAR. <br />6.5 Approvals <br />The Owner shall furnish required information and approvals <br />and perform its responsibilities and activities in a timely manner <br />to facilitate orderly progress of the Work in cooperation with the <br />CMAR, consistent with this Agreement, and in accordance with <br />the planning and scheduling requirements and budgetary <br />restraints of the Project. <br />6.6 Designer <br />The Owner shall retain a Designer whose services, duties and <br />responsibilities shall be described in a written agreement <br />between the Owner and Designer. The services, duties, and <br />responsibilities of the Designer set out in the agreement <br />between the Owner and Designer shall be compatible and <br />consistent with this Agreement and the Contract Documents. <br />The Owner shall, in its agreement with the Designer, require <br />that the Designer perform its services in cooperation with the <br />CMAR, consistent with this Agreement and in accordance with <br />the planning, scheduling and budgetary requirements of the <br />Project as determined by the Owner. The terms and conditions <br />of the agreement between the Owner and the Designer shall <br />not be changed or waived without written notice to the CMAR <br />provided at the time of the change or revision. <br />6.7 Budget <br />The Owner shall establish the Project and Construction Budget <br />and approve subsequent revisions deemed acceptable as <br />provided in this Agreement. <br />6.8 Separate Contracts <br />The Owner reserves the right to contract separately with other <br />entities to complete portions of the Work of the Project, or to <br />deploy its own employees to complete portions of the Work. If <br />the Owner contracts separately with any other parties, the <br />Owner shall cause all such agreements to be compatible and <br />consistent with this Agreement. Each of the agreements shall <br />include waiver of subrogation as required herein. The CMAR <br />agrees to cooperate with the Owner and its separate <br />contractors and coordinate the Work of all parties, including the <br />Owner's forces or separate contractors. Provided the CMAR <br />has reasonable advance notice of the identity and duties of <br />separate contractors, the CMAR agrees to include coordination <br />and support of the Owner's separate contractors in the General <br />Conditions costs. Disputes or conflicts between the CMAR, the <br />Owner and any separate contractors shall be subject to dispute <br />resolution in accordance with the dispute resolution provisions <br />in Appendix A. <br />6.9 Conies of Drawings and Specifications <br />The CMAR shall estimate the reasonable number of copies of <br />interim and final drawings, specifications and Contract <br />Documents required by the CMAR, and shall obtain such <br />copies from the Designer at the CMAR's expense. The <br />estimated cost of such copies shall be included in the <br />Guaranteed Maximum Price. <br />6.10 Permits and Approvals <br />With the cooperation and assistance of the CMAR and the <br />Contractors as set forth in this Agreement, the Owner shall in a <br />timely manner secure, submit and pay for necessary approvals, <br />easements, assessments, permits and charges required for the <br />construction, use or occupancy of permanent structures, or for <br />permanent changes in existing facilities. <br />6.11_Funding Requirements <br />The Owner shall describe the funding for the Project to the <br />CMAR and the Designer. <br />20 <br />
