1. Notification of Spills <br />a) Notwithstanding other requirements of law, as soon as any person <br />responsible for a facility or operation, or responsible for emergency <br />response for a facility or operation has information of any known or <br />suspected release of materials which are resulting or may result in illegal <br />discharges or pollutants discharging into or may reach the stormwater <br />collection system or waters of the Neuse River Basin in Orange County, <br />said person shall take all necessary steps to ensure the discovery, <br />containment, and cleanup of such discharge. In the event of such a <br />discharge of hazardous materials, said person shall immediately notify <br />emergency response agencies of the occurrence via emergency dispatch <br />services, and shall notify the County within twenty -four (24) hours. In the <br />event of a discharge of non- hazardous materials, said person shall notify <br />the County no later than the next business day. All notifications shall be <br />confirmed by written notice addressed and mailed to the County within <br />three (3) business days of the discharge. <br />b) Notification shall not relieve said person of: <br />(1) any liability or expense related to the discharge. <br />(2) restoration of any area affected by the discharge to preexisting <br />conditions. <br />(3) liability or violation of any regulatory body of the County, <br />State or Federal government. <br />Section 15 Inspections and Investigations <br />A. Site Inspections <br />Agents, officials, or other qualified persons authorized by the County will periodically <br />inspect on -site BMPs and illegal discharges to ensure: <br />1. compliance with the Act, this ordinance, or rules or orders adopted or issued <br />pursuant to this ordinance; <br />2. whether the measures required in the plan are being constructed in accordance <br />with the approved plan; <br />3. whether the permanent BMPs are in need of any maintenance including, but <br />not limited to, the following: <br />a) mowing of vegetation, <br />b) vegetation re- establishment, <br />c) tree removal (especially from wet detention ponds), <br />d) stabilization of any eroding areas, and <br />e) structural (pipe, riser, dam, etc) repair. <br />B. Notice of the right to inspect shall be included in the letter of approval of each <br />Stormwater Management Plan. <br />C.
