Orange County SE & SC Ordinance October 23 2007 <br />Section 18.1 Erosion Control Standards <br />A. Orange County Standards <br />Requirements, standards, and specifications for erosion control plans and erosion <br />control techniques, measures, and devices are contained in the Orange County Soil <br />Erosion and Sediment Control Manual. Copies of the Manual are available from the <br />Erosion Control Division of the Orange County Planning & Inspections Department. <br />B. Revisions to the Standards <br />Corrections, revisions, and amendments to the Soil Erosion and Sediment Control <br />Manual shall be made upon recommendation of the Erosion Control Officer and <br />approval by the Orange County Board of Commissioners. <br />C. Consistency Between Ordinance and Standards <br />Nothing in this Section shall be construed to allow approval of a plan which is <br />inconsistent with the mandatory standards set forth in Section 8 of this Ordinance or <br />any other provision of this Ordinance. <br />SECTION 19 APPEALS <br />A. Appeal Process <br />Except as provided in Section 19(B) of this Ordinance the appeal of a disapproval or <br />approval with modifications or conditions of approval of a plan shall be governed by <br />the following provisions: <br />1. The disapproval of, modification of, or conditions of approval attached to any <br />proposed Erosion Control Plan by the Erosion Control Officer shall entitle the <br />person submitting the plan to an appeal of the decision to the Orange County <br />Planning Director. If the Planning Director upholds the decision, the person shall <br />be entitled to a public hearing if such person submits written demand for a hearing <br />within 15 days after receipt of written notice of disapproval, modification, or <br />conditions of approval. <br />2. Hearings -Orange County <br />a. Hearings held pursuant to this section shall be conducted by the Orange <br />County Planning Board within 30 days after receipt of written demand for <br />such hearing made by the person submitting the plan when such plan is for <br />land - disturbing activities occurring outside the corporate limits of the Towns <br />of Chapel Hill, Carrboro, Hillsborough, and Mebane. <br />30 <br />
