STATE OF NORTH CAROLINA UTILITY CONNECTION AGREEMENT COUNTY OF ORANGE THIS UTILITY CONNECTION AGREEMENT made this day of , 2010, by and between , grantors, of Orange County, North Carolina, hereinafter referred to collectively as "Owner" and ORANGE COUNTY, a North Carolina county, grantee, hereinafter referred to as "County." WITNESSETH: THAT WHEREAS Owner certifies they are the owner of certain real estate, hereinafter referred to as "easement premises" described on Exhibit A attached to and incorporated herein by reference; and Parties have agreed it is in their best interest for Owner to connect to County's sanitary sewer system, hereinafter the "utility system," upon its construction and installation. THEREFORE, in consideration of the foregoing and the additional covenants contained herein, if any, the Parties agree as follows: 1. County obligations. The County agrees to construct and operate utility systems which will serve the property of Owner. The construction and operation of the utility system will further be subject to and performed in compliance with all regulations and ordinances which the County has now adopted and may adopt from time to time. 2. Owner obligations. agrees to install and pay for all expenses related to connection to the utility system installed by the County. Owner agrees to pay all charges for the operation of the utility system according to duly enacted rate schedules of the County and as they may be changed from time to time. Owner further agrees to pay all charges made whether or not s /he actually connects to the system once the system is placed in operation by the County. 3a. Availablity fee(s). Owner agrees to pay all charges for availability of the utility service to the Owner's property according to duly enacted rate schedules of the County and as those charges may be changed from time to time. Owner agrees to pay the availability fee(s) regardless of whether s /he makes use of the utility system.
