ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: June 15, 2010 <br />Action Agenda <br />Item No. 4- - n <br />SUBJECT: Pyrotechnics Permit - Orange County Speedway <br />DEPARTMENT: Asset Management and PUBLIC HEARING: (Y /N) No <br />Purchasing Services (AMPS) & <br />Emergency Services <br />ATTACHMENT(S): <br />Checklist <br />Permit <br />INFORMATION CONTACT: <br />Pam Jones, AMPS, 245 -2652 <br />David Sykes, Emergency Services, <br />245 -6100 <br />PURPOSE: To approve a pyrotechnics permit for Orange County Speedway for July 3, 2010. <br />BACKGROUND: Orange County Speedway has requested that the Board of Commissioners <br />approve a pyrotechnics permit for the fireworks display which is scheduled for July 3, 2010 in <br />conjunction with the regularly scheduled race. <br />North Carolina General Statute (NCGS) 14 -414 states that the Board shall consider a fireworks <br />permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or <br />amusement purposes." <br />NCGS 14 -413 empowers the Board to authorize and issue permits for the use of pyrotechnics <br />in connection with "...shows of all descriptions ... but only after satisfactory evidence is produced <br />to the effect that said pyrotechnics will be used for the aforementioned purposes and none <br />other." <br />County policy further requires assurance from the sponsoring agency that adequate public <br />safety measures will be exercised; and that the County will be protected as an additional <br />insured on the insurance policy(ies) covering the event. The documents attached indicate <br />satisfactory evidence that these requirements have been met. <br />The issuance of the permit is conditioned upon safe burning conditions being present on the <br />day of the fireworks presentation. <br />FINANCIAL IMPACT: There is no financial impact as a result of this action. <br />RECOMMENDATION(S): The Manager recommends that the Board approve a pyrotechnics <br />permit for the Orange County Speedway for July 3, 2010, pending verification of valid and <br />current insurance coverage, and authorize staff to execute permits as needed. <br />
