53 <br /> 122 Jeffrey Schmitt: I presume the state is trying to take care of us but under the auspices of whatever Orange County says we have <br /> 123 now expanded that by a factor of twenty fold. Since we have the capability to do this and the technology says that this can be <br /> 124 carved out and left at the zoning,one unit per one acre,why would we diminish the value and the right these people have with <br /> 125 those particular three parcels of property, no matter what they can or can't do with other restrictive covenants,simply to bring it <br /> 126 into a much larger,more restrictive basis. There is no argument we have for taking that in. <br /> 127 <br /> 128 Samantha Cabe: I don't look at this as canring out this isolated area. Going through the way Craig explained it,he explained the <br /> 129 watersheds around each of these areas that are necessary in the Planning DepartmenYs view of what is necessary to protect <br /> 130 these watersheds. This particular area is not necessary from the Planning Department's point of view to protect the watershed. I <br /> 131 don't see it as carving it out but rather it is not included in these critical area nodes. I agree with Jeff in why should we just throw <br /> 132 it in an include it just so it appears that we are not carving it out because there are individuals who own this properry,not Orange <br /> 133 County so if we don't need it to protect the water we should not mess with it. <br /> 134 <br /> 135 Larry Wright: I disagree totally because as Craig said,that realistically you could not build less than one house on two acres <br /> 136 because of the perk conditions on here. I agree with Mark that this in a watershed and there are two reservoirs there. We can <br /> 137 see streams that drain this watershed right in front of our eyes and i really feel very strongly, I live up here that this should be <br /> 138 within the protected area. <br /> 139 <br /> 140 Samantha Cabe: The statement that people can't build there given the soil is not necessarily a complete statement because <br /> 141 people can do engineered systems that cost more money but I think Mr.Benedict is referring to the fact the soil doesn't perk for a <br /> 142 traditional septic system. Someone could put additional house sites if they wanted to take the extra money to have an <br /> 143 engineered system so I don't think we need to assume they can't. <br /> 144 <br /> 145 May Becker: In terms of the arguments, I think it is important to consider the watersheds are very limited because you have <br /> 146 potentially infinite growth coming into this Counry and there's been a great push for growth but as a geologist and marine <br /> 147 scientist, I have looked at a lot of these types of studies in terms of what is known and what is not known, in terms of the <br /> 148 modeling techniques that they have used in the past and more recently and to think that you can simply do a study and then <br /> 149 reach conclusions as to what needs to be protected or not(tends to oversimplify the question). These are very limited resources <br /> 150 and have potentially unforeseen effects when it comes to contamination. I don't understand how you could have a line in 1994 <br /> 151 that effectively protected the watershed and then weaken the rules--unless you have a specific strong argument and reason to <br /> 152 weaken the rules--I don't understand why you would want to do that. <br /> 153 <br /> 154 Larry Wright: I agree totally with what she says and you can argue for development but the bottom line is no water flows into <br /> 155 Orange County. Our water flows out. <br /> 156 <br /> 157 Samantha Cabe: I am not necessarily saying we should not agree with all the critical areas they have identified. I guess I am <br /> 158 questioning this iso�ated area that if the studies are saying this is not a source of water,we shouldn't include it just to be including <br /> 159 it just so it looks like a complete map. <br /> 160 <br /> 161 Mark Marcoplos: This donut hole is surrounded by critical area. That is not random. It is within the boundaries of the critical <br /> 162 area so we are not taking a random site out of the critical area and saying that we are going to just put restrictions on that. It is in <br /> 163 critical area. It is all part of that same eco system. I don't know where the assumption came that it is not necessary to be <br /> 164 concerned about this land and I didn't ever understand the sophistication of the technology that was alluded to for monitoring <br /> 165 this. <br /> 166 <br /> 167 Craig Benedict: We could put identify this exact area on a map so if someone comes in to develop there is ease of <br /> 168 administration,whether it is in or out that in the old maps that we would have a more difficult time putting this on a GIS map now <br /> 169 that we have the technology. If there is such an aberration that we need to keep in there, we will be able to, from an <br /> 170 administrative standpoint track down in the future for any development potential. <br /> 171 <br /> 172 Mark Marcoplos: What would you be monitoring for? <br /> 173 <br /> 174 Craig Benedict: To know exactly where on what property where the line occurred between critical and protected. <br /> 175 <br /> 176 Mark Marcoplos: Couldn't you do that everywhere? <br /> 177 <br /> 178 Craig Benedict: Yes. We do that everywhere. <br /> 179 <br /> 180 Perdita Holtz: He is referring to 1994 hand drawn maps so there was more of a precision problem of being able to stipulate this <br /> 181 is the area that is out. <br /> 182 <br />
