PA <br />• Section 4.2.27 (Watershed Protection Overlay Districts) <br />• Section 6.23.3 (Stormwater Infiltration and Detention) <br />• Article 22 (Definitions) <br />Application of the text amendments will result in changes to the Watershed Protection Overlay <br />District boundary depicted on the official Zoning Atlas and on the Land Use Element Map of the <br />2030 Comprehensive Plan. The proposed text changes in "Track Changes" format are included <br />in Attachments 1 and 2. <br />BACKGROUND: The BOCC authorized staff to proceed with this item at the August 2009 <br />Quarterly Public Hearing (non - public hearing portion of the agenda) and it was discussed at the <br />October 13, 2009 BOCC work session. Changes to the "Critical Area" of the Upper Eno <br />watershed is one of the higher priority items to accomplish further implementation of the Efland- <br />Mebane Small Area Plan which calls for a re- evaluation of the Critical Area boundary for Seven <br />Mile Creek. <br />This item was heard at the February 22, 2010 Quarterly Public Hearing (QPH). The abstracts <br />for the QPH and March and April Planning Board meetings are provided as Attachment 10. <br />These previous abstracts include significant Background information that would be redundant <br />and space- consuming to include again here. <br />Revisions Since Quarterly Public Hearing <br />There have been small changes to the documents and maps since the February 22 Quarterly <br />Public Hearing as appropriate comments received during the public input process were <br />incorporated into the proposed amendments. The maps contained in Attachment 3 reflect the <br />current proposal. The specific changes that have occurred since the QPH are: <br />• Section 4.2.27 — The last bullet on page 2 (lower right corner) of the section was <br />added to exclude the land area north of the centerline of West Ten Road and west of <br />the centerline of the Interstate 85 /US 70 Connector from the County- designated <br />critical area (see Attachment 3.1 for location) <br />• Section 4.2.27 — Language was added to the sixth bullet on page 2 (lower right <br />corner) of the section to clarify that the intent of continuing the critical area <br />designation in an "isolated area" within the overall critical area boundary is to provide <br />a greater level of protection for an area that drains to protected streams. <br />• Section 4.2.27 — Table on page 3 (lower right corner) of the section. The source of <br />elevation data was added. <br />• Section 6.23.3 — page 10 (lower right corner) of the section. A sliding scale for <br />impervious surface ratios was added specifically for the Upper Eno (had previously <br />been covered by the existing scale on the left of the page which will now apply only to <br />University Lake, Cane Creek, and Little River). This change was discussed at the <br />QPH, but the scale was not available at the QPH. <br />Letters Received from Other Agencies <br />On March 18, 2010, the Town of Hillsborough sent the County a letter supporting the continued <br />protection of the Town's drinking water supplies through the proposed Critical Area <br />amendments. Additionally, the Orange - Alamance Water System (OAWS) sent a letter on March <br />30 expressing appreciation to Planning Director Craig Benedict for a presentation made on the <br />
