125 <br />7 <br />OA WS over the years about water quality protection but has not received comments <br />regarding this, specific proposal. <br />Written Comment Received <br />Staff received one written comment from a real estate agent representing the property owner of <br />the 79.23 acre parcel in the Efland area immediately north of Interstate -85/40 and west of the <br />US70 Connector. A portion of this parcel is currently in the Critical Area designation and will not <br />be fully removed from the designation under the proposed criteria presented at the Quarterly <br />Public Hearing. The comment requests that the Critical Area designation be removed from the <br />parcel completely and that the interstate be used as the Critical Area boundary line. Staff <br />comment: staff concurs that this area is designated for growth/economic development in the <br />Efland- Mebane Small Area Plan. Staff is suggesting that the proposed criteria in Section 4.2.27 <br />be revised to exclude the area north of West Ten Road, west of the US70 Connector, and south <br />of the railroad track from the Critical Area designation. The proposed text and maps <br />incorporating this suggestion are not yet available but will be distributed at the Planning Board <br />meeting. <br />Proposed Impervious Surface Amendments <br />In response to concerns voiced by property owners regarding impervious surface requirements, <br />staff re- visited Section 6.23.3 of the Zoning Ordinance (the section pertaining to impervious <br />surfaces). Staff is proposing additional amendments to this section to make it clear that <br />property owners with existing smaller -sized lots (under 5 acres) in the Critical Area are allowed <br />Impervious Surface Ratios higher than 6 %. This information was part of the Quarterly Public <br />Hearing presentation. The proposed amendments to Section 6.23.3 are included in Attachment <br />1. <br />FINANCIAL IMPACT: Funds for Small Area Plan implementation were included in the FY09 -10 <br />Budget. Following is a breakdown of expenditures related to the required notifications on this <br />project: <br />• Legal Ad: approximately $1875 <br />• Signs: $917 <br />• Postage for Mailed Notifications: $737 <br />• Printing of Notification Postcards: $116 (professionally printed and cut down to size <br />using cardstock Planning Department had on hand) <br />• Notification letters (paper, printing, labels, envelopes): used supplies Planning <br />Department had on hand <br />• Total staff time used for all aspects of notification process: approximately 65 hours <br />Staff time to research, write, coordinate, and map the amendments was significant and was <br />accomplished using existing Planning staff included in the Departmental staffing budget. <br />RECOMMENDATION: The Zoning Officer recommends the Board: <br />1. Deliberate as necessary on the proposed amendments. <br />2. Make a recommendation to the Board of County Commissioners in time for the June 1, <br />2010 BOCC regular meeting. <br />
