124 <br />6 <br />surface. Higher impervious surface limits in severed areas would be expected to lead to <br />greater runoff into sensitive streams. <br />5. An opinion that if Seven Mile Creek reservoir is not going to be built, the entire Critical <br />Area associated with the sub - watershed should be removed; the area is well- protected <br />with the "Protected" designation and AR (Agricultural Residential) zoning. As the memo <br />from ERCD in Attachment 7 indicates, there are significant aquatic resources in the <br />Seven Mile Creek area that warrant continued protection. <br />6. A question regarding where future water supplies will come from and an opinion that <br />other reservoir possibilities need to be looked at if economic development is desirable. <br />See discussion above under the "Planning Board Ordinance Review Committee" heading <br />regarding additional future water sources for Orange County. <br />7. An opinion that cutting density in half and reducing impervious surface will make a 20- <br />acre tract undevelopable for a subdivision — the stated purpose of acquiring the property <br />in the vicinity of Dimmocks Mill Road. Although one may not be able to have as many <br />lots in a future subdivision as is currently potentially allowed, this does not render a <br />property " undevelopable." As was discussed at the Quarterly Public Hearing, often soil <br />types in the county do not allow for smaller -sized lots because soils do not perk well. <br />While the zoning district may allow for lots as small as 40, 000 square feet (0.92 acres), <br />developers often need to plat larger lots in order to locate a well, septic system, and <br />septic repair area on a lot. <br />8. A statement that, when developing a subdivision, the subdivision's roads are subtracted <br />from the 6% impervious surface limit so the resulting impervious surface limit is less than <br />6% on a per -lot basis. This is correct. Lots in subdivisions fall under the provisions <br />adopted with subdivision approval which may be different from long- existing lots or <br />parcels located outside of major subdivisions. <br />9. A question regarding whether a destroyed non - conforming house can be re -built to the <br />same size. Yes, it can be rebuilt since the lot has not changed. <br />10.A concern that Interstate 85/40 is very close to Lake Ben Johnson and what would <br />happen if there is a chemical spill on the highway. Proximity to the Interstate is one of <br />the reasons the Town of Hillsborough did not construct a reservoir on Seven Mile Creek <br />and instead chose West Fork on the Eno. Orange County Emergency Services <br />Department has a Hazard Plan in place that includes addressing spills on the highway or <br />railroad tracks. <br />11. An opinion that some driveway surfaces should not be considered impervious surface. <br />Driveways are counted because the County does not count other semi pervious areas <br />such as lawns which can be up to 70% impervious. <br />12. An opinion that regulations do not allow the county to grow and increase tax base. <br />Orange County has designated targeted areas for growth and is pursing policies and <br />programs to bring economic development to these targeted areas. There are numerous <br />examples throughout the country where unplanned, haphazard growth has led to <br />suburban sprawl and inefficient provision of services as a result of the sprawl. Orange <br />County endeavors not to re- create problems other jurisdictions are dealing with due to <br />inefficient growth patterns. <br />13.A question on whether non - residential uses are allowed in the Critical Area. In the Upper <br />Eno Critical Area, non - residential uses are allowed only in the Cedar Grove Rural <br />Community Activity Node, in conformance with the Zoning Ordinance. <br />14.A question on whether input has been received from the Town of Hillsborough or Orange - <br />Alamance Water System (OAWS). Town of Hillsborough staff is aware of the proposed <br />changes and may provide comment at a later date. County staff has communicated with <br />
