The disapproval or modification of any proposed erosion control plan <br /> by the Erosion Control Officer shall entitle the person submitting f ; <br /> the plan to a public hearing if such person submits written demand Ii <br /> I for a hearing within 15 days after receipt of written notice of _ ! <br /> disapproval or modification. i I <br /> i <br /> b. (1) Hearings held .pursuant to this section shall be conducted by the <br /> f Orange County Planning Board within 30 days after receipt of written j <br /> demand for such hearing made by the person submitting the plan when <br /> such plan is for land-disturbing activities occurring outside the <br /> corporate limits of the towns of Chapel Hill, Carrboro, Hillsborough, <br /> and Mebane. <br /> (2) The Orange County Planning Board shall make recommendations to the <br /> j Board of Commissioners of Orange County within 30 days after the date ` <br /> ( of the hearing on such erosion control plan. <br /> !� (3) The Board of Commissioners of Orange County will render its final <br /> . decision on any erosion control plan upon which a hearing is requested <br /> within 30 days of receipt of the recommendations from the agency <br /> conducting the hearing. F. <br /> C. In the event that the local governing body upholds the disapproval or 1, <br /> modification of a proposed erosion control plan following the public <br /> hearing, the person submitting the erosion control. plan shall be entitled <br /> to appeal the local government's action to the North Carolina Department <br /> ! of Natural Resources and Community Development. The person submitting <br /> ` s the erosion control plan shall have 15-days following the disapproval <br /> { or modification of the plan by the local governing body to appeal the <br /> i decision to the Department of Natural Resources and Community Development <br /> Pursuant to Title 15 of the North Carolina Administrative Code, <br /> Subchapter 4B, Section .0018(b) and (c). i <br /> Amended Effective (April 8, 1980) !
