Authority to Sign Contracts <br /> a. County Department of Social Services <br /> In order for a county to exercise its power to <br /> contract, it must act through its county <br /> commissioners. The commissioners may delegate this <br /> authority to a specific county official(s). The <br /> county department of social services must therefore <br /> establish with the board of county commissioners <br /> which position(s) within the agency will have the <br /> authority to sign a contract and thereby be capable <br /> of legally binding the county. <br /> b. Provider Agency <br /> When the provider is another county agency, they too <br /> must act through the board of county-commissioners to <br /> determine authorization to enter into contracts. For <br /> private agencies, the county department of social <br /> services will need to determine with the provider <br /> through their corporation the identity of as officer- <br /> of the corporation or .a person who has written <br /> authorization to enter into contracts. <br /> 3. Contract Period , <br /> The contract must be signed by each party prior to the <br /> effective date of the contract. Claims for reimbursement <br /> are not allowable for expenditures incurred prior to the <br /> date on which the contract has been signed by all parties. <br /> Retroactive dating of a contract is not permissible. <br /> The contract may cover any apppropriate period as long as <br /> the contract period is no longeK than twelve months. There <br /> is no requirement that the beginning and ending dates of <br /> the contract period coincide with the fiscal year. <br /> However, if a rate has been established for a specific <br /> period, the contract period should end on or before the <br /> rate is to be re-established. <br /> 4.
