6 <br />~~e~;ba~r ~n~~ ~i,~~f~f`r«E'i~ <br />JUSTII+'1<CATdOI~T ~O~ 7C~IE ]~-~OlVXNG <br />®f the remainder of PIN 9'148-SQ-U366 from R.-1 to NC-2 <br />Property of <br />Timbexidge Rentals I,LG (a.k.a. `Vernon Davis) <br />The 2.iJ4 acre parcel of property is cturently split zoned with approximately 1.36 acres <br />zoned Rural Residential One (R-1) and the remaining zoned Neighborhood Cotnmeraial <br />Two (NC-2). The property in question is located within the White Cross Rural Activity <br />Node, which allows for non-residential development consistent with LC-1 of NC-2 <br />zoning designations. <br />The zoning of the property was coanpieted at a point in time where the Planning <br />Department allowed septic systems supporting non-residential developments to exist on <br />residentially zoned property, or portions thereof, supporting an existing non-residential <br />land use. This area of the County is notorious for poor soils with respect to the <br />absorption of wastewater Into septic fields. Septic systems were located where the most <br />appropriate soils were located on a given parcel of property regardless of the zoning <br />designation. <br />This opinion has changed over thne and staff no lorigex allows for the non-residential use <br />of residentially zoned property, including the location and operation of septic systems <br />and repair areas. <br />With.thesa feats in mind, the applicant desires re-zoning the remaining 1.34 acre portion <br />of the subject property from R-1 to NC-2 so that the existing septic system and repair <br />area are located entirely on a NG2 zoned parcel of property consistent with staff's <br />current interpretation of the Zoning Ordinance. <br />This proaotive n easure would also guarantee that complia~rce with Section 4.2,9 (b) (3) <br />.of tho Zoning Ordinance would be more quiclc>~y served with less disruption to the current <br />or future business located on-situ if the entire parcel was already zoned NC-2, should <br />future conditions so dictate. <br />
