STATEMENT OF PURPOSE <br /> It is the purpose of the program to protect irreplaceable prime farmland <br /> from encroachment by and loss due to-the development of such lands for <br /> residential and other uses and to minimize pressures for the conversion <br /> of prime and locally important farmland to other use by provisions designed <br /> to: <br /> a) minimize land use conflicts between farms and <br /> residences and the incidence of nuisance suits <br /> b) preserve agricultural activity as a-viable <br /> component of the local economy and an industry <br /> as of right <br /> c) defend the "right to farm" <br /> d) alleviate tax burdens on agricultural land <br /> e) minimize the conversion of prime farmland to <br /> other uses <br /> f) minimize the impact of the use of eminent domain <br /> for public projects on prime and locally important <br /> farmland and agricultural activity <br /> g) provide for the formation of Voluntary Agricultural <br /> Districts <br /> h) provide for the establishment of an Agricultural <br /> Advisory Board <br /> PROPOSED PROGRAM FEATURES <br /> A. MINIMIZE LAND USE CONFLICTS BETWEEN FARMS AND RESIDENCES AND REDUCE THE <br /> INCIDENCE OF NUISANCE SUITS <br /> APPROACHES: <br /> 1. Disclosure statement for all land transfers within 600 feet of all <br /> bona fide farm tracts and within one—half mile of all poultry, <br /> swine and dairy bona fide farm tracts informing purchasers of the <br /> preferred and pre—existing nature of the agricultural use of the <br /> adjoining tract. t <br /> ADVANTAGES <br /> formally written notification of prospective <br /> of pre—existing farm uses <br /> possible use as evidence of plaintiff's awareness of farming <br /> opera4ion in nuisance suits <br /> I <br />
