Hold a Public hearing, <br />2. Close the Public Hearing, <br />. - 3. ~ Consider an amendment to the Flood Damage Prevention Ordinance (FDPO), and <br />4. Authorize staff to initiate the Zoning Ordinance amendment process to incorporate-the <br />Flood Insurance Rate Map (FIRM) into the Zoning Ordinance as a new overlay district <br />and to incorporate the •FDPO into the Zoning Ordinance by reference. <br />BACKGROUND: The proposed amendment to the County's FDPO is a Federally mandated <br />change and is necessary in order to incorporate the newly revised Flood Insurance Rate Study <br />and FIRM for Orange County into the FDPO. The September 14, 2005 letter from Cheryl A. <br />Perry and the December 12, 2006 letter from the County Attorney's office both state that the <br />FDPO must specifcally reference the effective date of the new FIRM. Further, staff to the North <br />Carolina Floodplain. Management Branch of the Division of Emergency Management has <br />requested that Orange County revise its FDPO to specifically incorporate the new FIRM and its <br />effective date, after holding a public hearing on the proposed amendment. <br />The proposed amendment to the FDPO will meet the technical requirements requested by <br />FEMA and the State Floodplain Mapping Program. Orange County must adopt a revised FDPO <br />that specifically references the new FIRM and its effective date prior to February 2, 2007 in <br />order to remain eligible to participate in the National Flood Insurance Program. <br />Planning Staff also requests that the BOCC authorize staff to initiate the Zoning Ordinance <br />amendment process to in~rporate the FIRM into the Zoning Ordinance as a new overlay district <br />
