Request for Rezoning - Fred and Elizabeth Cates: A summary of the <br /> discussion is as follows: <br /> Mr. Cannity: On the August 2nd meeting, the Board deferred action <br /> on the request by Fred and Elizabeth Cates for rezoning <br /> a 4 acre tract of land that lies off of Orange Grove <br /> Road near the existing Cates Farm Development. It was - <br /> asked that it be put on the agenda for action on the 17t:,, <br /> Mr. Cannity proceeded to read a letter from Mr. McAdams <br /> i asking that the matter be deferred until sometime in the <br /> future, such deferral will enable us to apply to the <br /> County for a planned development in lieu of the rezoning <br /> request. <br /> Commissioner Whitted: At that time he asked that we delay it because his client <br /> had been out of town and had not har the opportunity to <br /> bring him up to date on the status after the Planning <br /> I Board had made its recommendation. <br /> 1 Mr. McAdams: What we would like to do is defer it at your preference <br /> sometime in the future. This will give us a chance to <br /> give him a planned development on it. We haven't had <br /> time to get a planned development since the request came <br /> E in. All we are trying to do is buy a little more time <br /> to get a planned development. <br /> Mr. Roland Wagoner: Mr. Chairman what Mr. Cates is asking for really is a <br /> withdrawal--A,-I didn't mare it let me back up and not <br /> wait the one year that's required by the County Zoning <br /> Ordinance. I've been through that Ordinance and there <br /> is absolutely no provisions for regrouping, that's not <br /> l bankruptcy that's the Zoning Ordinance. 5o I believe <br /> that he was advised -the Planning Department when he <br /> first made the application for an R-8 that he go with <br /> a Planned Development but he decided not to do it he'd. <br /> rather go with an R-8. I think he took his cha,r,-os, he <br /> didn't think he would get any resistance so I believe <br /> its necessary to go ahead and make a decision on this <br /> matter. Give the Planning Board a year to work out <br /> with Mr. Cates and go with Planned Development. <br /> situation as it is will only cause more friction r.•� <br /> elevate the -temper and things like that. Any ha_.:_,-,- <br /> decisions of trying to come up with a developmenL. ,;ould <br /> just make matters worse. <br /> Mr, Geoffrey Gledhill : The request cannot be withdrawn. <br /> Commissioner Gustaveson:We postponed this the last time. It seems that the <br /> Planning Board has examined this very carefully and the <br /> substance of the proposal fails a number of findings. <br /> I think we should move ahead and act. The Public Hearing <br /> we have had the people woo are concerned about this, the <br /> Planning Board has acted and I would -so move that we <br /> accept the Planning Board recommendation, Commissioner <br /> Marshall seconded the motion. <br /> Commissioner Whitted: A� I expressed at the August 2nd meeting, one of the <br /> f ncerns that I have is the integrity of the zoning <br /> ,cocess. We have had in the past persons to request <br /> rezoning and then get to the Dublic hearing and with-. <br /> draw t sir re,,02st.
