However, <br />when making application for CAPS, residential developers may request approval for a future <br />time certain when new units would be occupied, such as expected Certificate of Occupancy <br />(CO) dates, versus time of unit or lot approval. This permits development approvals with the <br />understanding that adequate school capacity will be available at the time residential units will <br />be occupied, potentially by families with school age children. Phasing of developments is <br />also permitted to ensure adequate future school capacity. CAPS approvals can be timed to <br />coincide with Elementary School #11 coming online, if necessary. <br />Updated Student Generation Rates- <br />The Board of Education also expressed concem with the process for updating the Student <br />Generation Rates. The memo states "that this process was too long and that recently <br />approved developments have had a greater impact on student populations than is currently <br />being calculated during the CAPS process." The Board of Education recommended that <br />future studies be circulated to SAPFO partners more quickly to allow for a timelier <br />implementation. <br />Staff notes the concern of the Board of Education. However, the process by which Student <br />Generation Rates and other SAPFO components are modified is established in the <br />Memorandums of Understanding (MOU) which all SAPFO partners are party to. The MOUs <br />require changes to the SAPFO components, including Student Generation Rates, to be <br />approved by the BOCC prior to February 1St of the year such changes are to be <br />implemented. Following the recommendation(s) of the SAPFOTAC, the MOUs require the <br />BOCC to provide an opportunity for the SAPFO partners' governing boards to comment on <br />those recommendations. In order to shorten the process for implementing changes to <br />SAPFO components, all parties to the Memorandums of Understanding (MOUs) must <br />approve and execute a revised agreement. <br />The BOCC adopted the new school impact fee schedule in December of 2008; based on <br />the 2007 TischlerBise report. At that time, the Board requested the SAPFOTAC proceed <br />with updating the Student Generation Rates identified in the TischlerBise study. The <br />SAPFOTAC discussed the Student Generation Rates at the February 2009 meeting and <br />proceeded with the recommendation to update the Student Generation Rates. Following <br />the procedures established in the MOUs, the updated Student Generation Rates were <br />approved by the BOCC in October 2009, thereby pushing their implementation to November <br />2010. <br />The valuable comments and input provided by Chapel Hill-Carrboro City Schools are <br />always appreciated. The responses included in this memorandum are intended to <br />address any questions generated as a result of the April 1, 2010 memo. <br />
