Mr. Cannity enumerated the requirements of the Zoning <br /> Ordinance for a Special Use Permit with American Stone Company's responses. <br /> Commissioner Barnes thanked Mr. Cannity for his presentation. Mr. Paxton <br /> '• Badham represented American Stone Company; his remarks follow in an abbrev- <br /> 1 • iated version. American Stone Company has never had a public hearing before <br /> -•-Z�• and this is a new experience for them. They have hired a court recorder so <br /> ~_ that they would know what occurred and perhaps aid them in another County <br /> at a future date. Mr. Badham introduced a letter into evidence from <br /> Phillip R. Berger & Associates, Inc. (A copy of that letter is on permanent <br /> 1j. file in the office of the Clerk to the Board and a copy is included on page (p� <br /> % of these minutes.) <br /> American Stone Company first learned of the proposed Zoning Ordinance in <br /> 1979, and were disappointed there was no grandfather clause permitting <br /> operation of those non-conforming uses already in existence. Mr. Badham noted <br /> the discrepancy between what they had been told for the past two years and <br /> aY• what had happened during the last- two months (he did not elaborate). Mr. <br /> ]• Badham said American Stone Company had begun operation in 1969 at the old site <br /> �• across SR 1154 and operated there until 1978, with no complaints from the <br /> citizens. In 1977 American Stone Company began operation at the new site <br /> 2 G. (described by Mr. Cannity on the previous page),- He said there had been no <br /> 29. complaints from citizens about operations on the new site. He listed various <br /> �J4 State and Federal Regulations and Bureaus which oversee American Stone Company's <br /> operation (two examples are the North Carolina Mining Act and North Carolina <br /> • Department of Labor). Mr. Badham said American Stone Company has an enormous <br /> 6 "desire to grow with tomorrow."
