9 <br />1 Joint Planning Area meeting scheduled for October 11, 1995. In answer <br />2 to a question from Commissioner Willhoit about the performance <br />3 standard, Ms. Willis said that the standard stipulates that the <br />4 proposed rate of flow from development must not be increased by the <br />5 proposed development. There is no way to correct a problem after the <br />6 fact if it does not meet the standards. <br />7 A motion was made by Commissioner Willhoit, seconded by <br />8 Commissioner Crowther to approve the rezoning as requested by Donald <br />9 Keith Godwin for property owned by Thomas Walker and Gail Harris <br />10 including an amendment to both the Orange County Zoning Atlas and the <br />11 Carrboro Zoning Map. <br />12 VOTE: AYES, 4; NOS, 1 (Commissioner Gordon) <br />13 <br />14 <br />15 X. REPORTS <br />16 A. COMPLAINT - JIM CONNORS PROPERTY/DAIRYLAND ESTATES <br />17 Planning Director Marvin Collins made reference to a <br />18 complaint from Jim Gray about Jimmy Connors operating an illegal <br />19 landfill in Dairyland Estates. Mr. Collins said that after an <br />20 inspection of the property in question, it appears that Connors has <br />21 cleared about two-thirds of the site over the last two years. Dirt <br />22 from the McDougle Middle School site is being hauled by contract <br />23 haulers to Mr. Connors' property for the purpose of constructing a pond <br />24 dam. The site inspection provided no evidence of any landfilling <br />25 activity, only the construction of a pond and associated dam. There is <br />26 no zoning violation. He has ceased hauling except for some stone he <br />27 plans to use for landscape purposes. Mr. Connor will need an Erosion <br />28 Control permit and he may need a dam permit. <br />29 Erosion Control Supervisor Warren Faircloth will work with <br />30 Mr. Connor on sizing the drainage basin that would drain through the <br />31 pond and encourage him to prepare a plan for the dam. He told Mr. <br />32 Connor about the permits he will need and about the construction <br />33 standards required for the development of this pond. Mr. Connor should <br />34 have had an Erosion Control permit before he began this activity. It <br />35 is doubtful if he will bring any additional dirt into the area. Mr. <br />36 Connor is not certain how large the pond will be or where the dam will <br />37 be located. Mr. Faircloth will meet with Mr. Connor again next week as <br />38 well as his neighbor and a surveyor. Mr. Connor realizes that he needs <br />39 more definite plans for this pond which will be an acre or larger and <br />40 is willing to do what is necessary for proper drainage. <br />41 <br />42 B. HUNTING ORDINANCE REVIEW <br />43 The Board received information on the issues identified by <br />44 the Hunting & Fishing Ordinance Committee as possible amendments to the <br />45 current ordinance as listed in the agenda abstract. <br />46 A motion was made by Commissioner Gordon, seconded by <br />47 Commissioner Crowther to receive the report as information and to set <br />48 October 2, 1995 as the date to receive public comments on the ideas <br />49 proposed in the report and to ask that the members of the Hunting & <br />50 Fishing Ordinance Committee be present at the public hearing and that <br />51 this Committee make specific proposals on and changes to the Ordinance <br />52 after considering citizen comments. <br />53 VOTE: UNANIMOUS <br />54 <br />55 <br />56 <br />
