3 <br /> application of protest provisions. <br /> • Protest Petition was received by the Town on April 12, 1993. <br /> • memo was received from Robin Lackey to the Mayor and Board of <br /> Aldermen regarding the protest petition submitted by nine members of the <br /> Small Area Planning Work Group. <br /> A letter from Mr. and Ms. H. Taylor Vaden to Roy Williford and Marvin <br /> Collins opposed the rezoning. <br /> A telephone call was received from Joe and Barbara Arendt voicing <br /> opposition to the proposed rezoning. <br /> A memorandum from John Hartley indicated opposition to this rezoning <br /> request. <br /> Dan Jewell, representative for the applicants of the proposed <br /> rezoning, stated that the rezoning request of the applicants would be <br /> amended to withdraw one-hundred feet (1001 ) from the southern border of <br /> the property, to allow a 100-foot buffer area between the original <br /> rezoning request boundary and the Stoney Hill Subdivision. This amended <br /> request reduces the acreage of the proposed rezoned area. Mr. Jewell <br /> stated that the proposed rezoning request does not mean that the land will <br /> be annexed or that the land will be developed at five units per acre. He <br /> also stated that development of the land would not be a project that would <br /> happen immediately but would be a project developed over the next decade <br /> or so. Mr. Jewell stated that public water and sewer would service the <br /> area and low to moderate density development is the goal of the <br /> applicants. <br /> THE PUBLIC HEARING WAS OPENED FOR COMMENTS FROM THE BOARD OF <br /> COMMISSIONERS, BOARD OF ALDERMEN AND/OR PLANNING BOARD. <br /> Alderman Jacquelyn Gist questioned the effect of the applicant's <br /> amended request of allowing a 100' buffer along the southern border of the <br /> property. <br /> i Michael Brou h explained that by law, the 100' buffer nullifies the <br /> petitioners' protest petition. The law does allow an applicant to lessen <br /> the area to be rezoned prior to or during the hearing of the request. <br /> Commissioner Gordon asked whether a fiscal impact analysis had been <br /> done and, if so, asked that it be shared with the Board. Mr. Jewell <br /> stated that a fiscal impact analysis had not been done, but that one could <br /> be completed and shared with the Board. <br /> Commissioner Willhoit questioned the status of the trailer park and <br /> requested that staff give a report listing the subdivisions in the <br /> transition area, with lot sizes and the density of each development. <br /> Commissioner Gordon added that a map depicting land use activity in <br />
