7 <br /> He feels there are a lot of bad hunters giving the good hunters a bad <br /> reputation. He does not support the proposed local legislation. His <br /> main objection is the registration of land entry. He stated his dog <br /> cannot read. He is going to follow his dogs whether or not he has <br /> permission. It is hard to know whose land a person is on when in the <br /> woods. He is not willing to give someone written permission because of <br /> the liability in case they would get hurt. He stated that his group <br /> would be willing to meet with the Board to discuss this issue further. <br /> Chairman Carey clarified with Wildlife Office Mr. Lester that <br /> the permission form that Mr. Pannell made reference to was for those <br /> lands which are registered through the Wildlife Commission. The County <br /> would not adopt a form. The proposed local legislation would provide <br /> that the act of granting written permission pursuant to a local <br /> ordinance shall not of itself subject the owner or lessee to the <br /> increased duty owed to an invitee or licensee under principles of the <br /> common law. It is designed to not create any special liability to the <br /> landowner. <br /> DAVID DAVIS, member of the Eno River Coon Association and <br /> Caldwell Hunting Club, indicated he hunts in one bottom which crosses <br /> nine properties and that he does so with verbal permission. He stated <br /> that he hunts on practically all of the land in the Caldwell Community <br /> and has a lot of it posted "No Hunting - Caldwell Hunting Club". He <br /> objects to carrying written permission to hunt on someone's land. They <br /> walk for miles and do not know whose land they are on at any one time. <br /> BILL RILEY, President of the Occoneechee Hunting Club, stated <br /> that according to the law of the State of North Carolina you have to <br /> have permission to hunt on anybody's property in this state. The only <br /> problem is that the individual landowner is the one that must prosecute <br /> if a person is illegally hunting on his land. This proposed local <br /> legislation protects the landowner. He suggests that this bill specify <br /> "written permission from the landowner or lessee" and that a hunting <br /> club could get one written permission for all the members of that club. <br /> On the spotlighting issue, he supports legislation this because it will <br /> help the Sheriff and also prevent some unlawful hunting of deer. A <br /> person may be prosecuted for trespassing after they have been given a <br /> verbal warning. <br /> BILL RAY has not personally had any problem with unlawful hunters <br /> or nightlighting. He feels that the Registered Land Program already in <br /> place says practically the same thing as the proposed local legislation. <br /> He stated he has six ponds and people fish on the honor system. He does <br /> not feel the ordinance is necessary. With reference to the <br /> nightlighting, he stated that in Caswell County the Ordinance did not <br /> stop the nightlighting. The people this restricts are those who go out <br /> with their children to show them deer. He does not want more <br /> restrictions put on people.
