Housing and Urban Development, or their duly authorized representatives, for the <br />purpose of making audit, examination, excerpts and transcriptions. <br />The periods of access and examination described above, for records which related to <br />litigation or the settlement of claims arising out of the performance of this contract, <br />or costs and expenses of this contract as to which exception has been take by the <br />COUNTY, the Comptroller General of the United States, the U.S. Department of <br />Housing and Urban Development, or their duly authorized representatives, shall <br />continue until such litigation, claims, or exceptions have been disposed of. <br />5. Nondiscrimination Clause -Section 109, Housing and Community Development Act <br />of 1974: <br />5.1. No person in the United States shall on the grounds of race, color, national <br />origin or sex be excluded from participation in, be denied the benefits of, or be <br />subjected to discrimination under any program or activity funded in whole or in part <br />with funds available under this title. <br />6. Equal Employment Opportunity Clause - Executive Order 11246 Clause: <br />(Applicable to all construction contracts awarded in excess of $10,000 by <br />grantees and their contractors or subcontractors.) <br />6.1. During the performance of this contract, the contractor agrees as follows: <br />The Contractor will not discriminate against any employee or applicant, for <br />employment because of race, color, religion, sex, or national origin. The contractor <br />will take affirmative action to ensure that applicants are employed, and that <br />employees are treated during employment, without regard to their race, color, <br />religion, sex, or national origin. Such actions shall include, but not be limited to the <br />following: employment, upgrading, demotion, to transfer; recruitment or recruitment <br />advertising; layoff or termination; rates of pay or other forms of compensation; and <br />selection for training, including apprenticeship. The Contractor agrees to post in <br />conspicuous places, available to employees and applicants for employment, notices <br />to be provided by the contracting officer setting forth the provisions of this <br />nondiscrimination clause. <br />The contractor will, in all solicitations or advertisements for employees placed by or <br />on behalf of the contractor, state that all qualified applicants will receive <br />consideration of employment without regard to race, color, religion, sex or national <br />origin. <br />The Contractor will send to each labor union or representative or workers with which <br />he has a collective bargaining agreement or other contract or understanding, a notice, <br />to be provided by the agency's contracting officer, advising the labor union or <br />workers' representative of the contractor's commitments under Section 202 of <br />
