64 Animal Services Advisory Board (ASAB) Approved Minutes for March 19, 2008 Meeting Present ASAB Members. Daniel Textoris, Pat Sanford, Susan Elmore, Jean Austin, James Kramer, Moses Cary, and Kristine Bergstrand. Absent ASAB Members: Ross Oglesbee, Bonnie Norwood, Tracy Carroll, Dewana Anderson, Suzanne Roy and Rachel Beckham. Others in Attendance: Animal Services Director Bob Marotto, Animal Shelter Manager Jessica Allison, Animal Control Manager Irene Phipps and Administrative Assistant Paula Ragan. Public Members Present. Elliott Cramer Welcome and Opening Comments ASAB Co- Chair, Susan Elmore, called the meeting to order. Motion was made by James Kramer and seconded by Daniel Textoris to approve the Agenda dated March 19, 2008 with one change to add an item to discuss the Carolina North chemical remediation. VOTE: Unanimous. Motion was made by Daniel Textoris and seconded by Kristine Bergstrand to approve the minutes dated February 20, 2008 with one change to add `It was understood that the permit requirement and ordinance would be revisited at a later date" to bullet four on page 2. VOTE: Unanimous General Public Comment—None Unfinished Business— Tethering Ordinance Update— Bob Marotto reported that there were two issues with additional changes made in the proposed amendment by the county attorney since the last meeting. (1) the exemption of existing kennel permits from the enclosure requirement; and (2) matter of notice in the event that an animal is seized and impounded under the proposed amendment.. The County Attorney has since then received information regarding related litigation that is occurring now in Wake County and the issue in that litigation is the issue of notice. The County Attorney thought it would be best to incorporate those changes at the same time. In addition, a member of the board indicated that there was an inconsistency in the restrictive language of the proposed Tethering Document. After considerable discussion, a motion was made by Kristine Bergstrand and seconded by Moses Cary that the Tethering Committee would reconvene as a matter of procedure to decide on a consistent language and make a recommendation to the ASAB. VOTE. Unanimous Bob Marotto reported that at the commissioner's work session it was suggested that we go forward with the amendment and as we proceed there should be some period of time designated for the proposed preliminary Amendment and FAQ to be available for the community to review on our website and in media advisories. This would be a prelude to the scheduling of the item on the BOCC Agenda.
