Resolution Approving a No Fault Privately-Owned Well Repair Concept and <br /> Authorizing the Development and Implementation of a No Fault Privately-Owned Well <br /> Repair Policy for Properties Near the Orange County Landfill <br /> The Board considered a resolution approving a no-fault privately-owned well repair <br /> concept and authorizing staff to proceed with the development and implementation of a no- <br /> fault privately-owned well repair policy for properties near the Orange County Landfill and <br /> authorizing the Chair to sign. <br /> Frank Clifton said that the staff drafted the resolution and he said that parameters are <br /> in the abstract. This item deals with residential wells within a zone of 3,000 feet of the existing <br /> landfill and it offers three alternative approaches — repair, replacement of well, or connectivity <br /> to existing water line. This does not address septic systems. He said that the Health <br /> Department has tried to do some analysis in this area and they have not found any real <br /> problems, but there is still a resolve to address this problem. <br /> Commissioner Yuhasz asked about the status of new wells and if they would be eligible <br /> for repair at some point in the future. Frank Clifton said that the County Commissioners would <br /> have to decide this. This resolution addresses existing wells. <br /> Commissioner Jacobs said that this is a creative and sensitive response to this <br /> problem. When the water line was extended, he suggested that many of these septic systems <br /> need to get pumped and the County may need to address this and educate, because a failing <br /> septic tank could be affecting the quality of the water. <br /> Commissioner Jacobs said that, once these parts of the neighborhood are annexed, <br /> then the municipal responsibility for providing the service should kick in.
