Secondary Roads Investigation Reports <br />PURPOSE: To make a recommendation to the North Carolina Department of Transportation <br />(NCDOT) concerning a petition to add subdivision roads in Tuscany Ridge Subdivision to the <br />State Maintained Secondary Road System. <br />BACKGROUND: The Board of County Commissioners (BOCC) approved Tuscany Ridge <br />Subdivision on June 27, 2002 through the major subdivision process with Tuscany Drive and <br />Front Street as public roads. (Front Street was later renamed Craftsman Street on the Final <br />Plat.) The developer of Tuscany Ridge Subdivision has petitioned the North Carolina <br />Department of Transportation to accept maintenance responsibilities for Tuscany Drive (8 <br />homes) and Craftsman Street (8 homes). Tuscany Ridge is located off the north side of Arthur <br />Minnis Road in Chapel Hill and Bingham Townships. <br />This application meets the criteria endorsed by the BOCC for recommending acceptance of a <br />public road into the State Maintained System for roads approved through the governing <br />jurisdiction's major subdivision process. <br />NCDOT has investigated this request (please refer to Attachment 4) and has submitted the <br />petition to the BOCC for its review and recommendation. In accordance with North Carolina <br />General Statute §136-62', the Board is required to make a recommendation regarding the <br />petitions to the North Carolina Board of Transportation (NCBOT) before the NCBOT can <br />consider the petitions. <br />FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br />item. NCDOT will incur additional maintenance responsibilities and costs. <br />" North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present <br />petitions to the board of county commissioners, and through the board to the Department of Transportation, <br />concerning additions to the system and improvement of roads. The board of county commissioners shall receive <br />such petitions, forwarding them on to the Board of Transportation with their recommendations." <br />
