transmitted by the Contractor to the Department, and to state the terms and conditions as to the <br />manner in which the Project will be undertaken and completed. <br />Section 2. Project Implementation. The Contractor shall carry out the Project as follows: <br />a. Scope of Project. The Contractor shall undertake and complete the <br />nonurbanized area public transportation services in accordance with the procedures and <br />guidelines set forth in the following documents: <br />(1) Federal Transit Administration (hereinafter referred to as "FTA ") <br />Circular 9040.1 E, dated October 1, 1998, at: <br />(www.fta. dot. gov / publications / publications_ circulars_guidance.html); <br />(2) FTA Master Agreement, FTA MA (15), October 1, 2008), <br />at (www.fta. dot .gov /documents /15- Master.doc); <br />(3) The State Management Plan for Federal and State Transportation <br />Programs (hereinafter referred to as "State. Management Plan "); <br />(4) The Section 5311 grant application for financial assistance; and <br />(5) The Community Transportation Improvement Plan for Orange County. <br />The aforementioned documents, and any subsequent amendments or revisions thereto, are <br />herewith incorporated by reference, and are on file with and approved by the Department in <br />accordance with the terms and conditions of this Agreement. Nothing shall be construed under <br />the terms of this Agreement by the Department or the Contractor that shall cause any conflict <br />with Department, State, or Federal statutes, rules, or regulations. <br />b. Cost of Project. The total cost of the Project approved by the Department is <br />ONE HUNDRED EIGHTY -NINE THOUSAND TWENTY -FIVE DOLLARS (189,025) as set forth <br />in the Project Description and Budget, incorporated into this Agreement as Attachment A. The <br />Department shall provide, from Federal and State funds, the percentages of the actual net cost <br />of the Project as indicated below, not in excess of the identified amounts for eligible <br />administrative, operating, and capital expenses. The Contractor hereby agrees that it will <br />provide the percentages of the actual net cost of the Project, as indicated below, and any <br />amounts in excess of the Department's maximum (Federal plus State shares).
