STATE OF NORTH CAROLINA <br />COUNTY OF WAKE <br />NORTH CAROLINA <br />DEPARTMENT OF TRANSPORTATION <br />and <br />ORANGE COUNTY <br />.Z -/17- Aosm,9 <br />Please return this copy to <br />Clerk to the Board's office for PAF <br />NONURBANIZED AREA <br />PUBLIC TRANSPORTATION <br />GRANT AGREEMENT FOR <br />PUBLIC BODY ORGANIZATIONS <br />COMMUNITY TRANSPORTATION <br />PROGRAM - SECTION 5311 <br />CFDA NUMBER: 20.509 <br />PROJECT NUMBER: 10 -CT -056 <br />THIS AGREEMENT made this theA day of <- , 20Z� (hereinafter referred to as <br />AGREEMENT) by and between the NORTH CAROLINA DEPARTMENT OF <br />TRANSPORTATION (hereinafter referred to as "Department ", an agency of the State of North <br />Carolina) and ORANGE COUNTY, (acting in its capacity as the designated Section 5311 <br />recipient hereinafter referred to as the "Contractor "). <br />WHEREAS, Chapter 53 of 49 U.S.C. app 5311 et seq. (formerly Section 18 program) <br />provides federal administrative, operating, and capital assistance for public transportation in <br />rural and small urban areas by way of a formula grant program to be administered by the State; <br />and <br />WHEREAS, the purpose of 49 U.S.C. 5311 is to enhance access of people in <br />nonurbanized areas for purposes such as health care, shopping, education, recreation, public <br />services, and employment by encouraging the maintenance, development, improvement, and <br />use of public passenger transportation systems; and <br />WHEREAS, the Contractor has been designated as the recipient of 49 U.S.C. 5311 <br />funds, and <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes (N.C.G.S.) <br />designated the Department of Transportation as the agency of the State of North Carolina <br />responsible for administering all Federal and /or State programs relating to public transportation, <br />and granted the Department authority to do all things required under applicable Federal and /or <br />State legislation to properly administer the public transportation within the State of North <br />Carolina; and <br />WHEREAS, the Governor of North Carolina, in accordance with Section 631.4 of the Safe, <br />Accountable, Flexible, and Efficient Transportation Equity Act - A Legacy for Users (SAFETEA- <br />LU), Public Law 109 -59, August 10, 2005, and the Transportation Equity Act for the 21St Century <br />(TEA -21), Public Law 105 -178, June 1998, as amended, has designated the North Carolina <br />Department of Transportation as the agency to receive and administer Federal funds under this <br />program; and <br />WHEREAS, in order to assist in providing transportation services, the Department, under <br />the terms of this Agreement shall make grants of administrative, operating and capital <br />assistance to the Contractor; and <br />WHEREAS, the Department and the Contractor desire to secure and utilize Section 5311 <br />grant funds and State funds for the above referenced purposes. <br />NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the <br />Department and the Contractor agree as follows: <br />Section 1. Purpose of Agreement.
