E <br />d. What was the offense that led ICE to take action against a detainee and what <br />Priority Level did ICE consider the offense? <br />e. Had a detainee been previously convicted of the stated offense or is he (she) <br />currently accused of the offense? <br />f. What is prior arrest history of detainees if any? <br />g. What is their nationality and /or citizenship? <br />h. What is their immigration status? <br />i. What is their race and ethnicity? <br />j. Does ICE track the outcomes of their immigration cases and can the county <br />get that data? <br />Pros and Cons of requesting data from the Sheriff and ICE <br />Cons <br />a. There is no guarantee ICE will voluntarily release the data. <br />b. ICE may agree to release the data and then delay or not follow through. <br />Pros <br />a. Sheriff has already met with the HRC and has agreed to release the data <br />available to him. <br />b. Release of the data will bring about increased transparency and promote trust <br />between law enforcement and the broader community. <br />II. Grievance and Complaint procedure <br />We recommend that the BOCC request that a complaint procedure, modeled on <br />the 287(g) complaint procedure, be set up to enable people to lodge complaints if <br />their rights are violated in the enforcement of "Secure Communities" in the <br />county. This complaint procedure would include the ability to file complaints for <br />violations including cases where people feel that their arrest was a result of racial <br />profiling and cases where people were detained by ICE and the arrests were not <br />for either Level I or Level II priority crimes as outlined in the ICE priority <br />guidelines. (A detailed definition of these terms can be found in the attached <br />report from the Immigration Policy Center.) The complaint procedure should be <br />available in both English and Spanish and widely disseminated, including on the <br />county website and through the Spanish and English media. <br />Pros — <br />a. Enables BOCC to track whether program is being implemented correctly. <br />
