Resolution Ratifying Interlocal Agreement <br />INFORMATION CONTACT: <br />Craig Benedict, Planning Director, <br />245- 2592 <br />Perdita Holtz, Planning Systems <br />Coordinator 245-2611 <br />PURPOSE: To consider the version of the Interlocal Agreement adopted by the Town of <br />Hillsborough. <br />BACKGROUND: At the June 2, 2009 BOCC meeting, the Board approved an Interlocal <br />Agreement with the Town of Hillsborough pertaining to the jointly prepared Strategic Growth <br />Plan. The version the BOCC approved contained language added by County staff that the <br />Town of Hillsborough had not approved on April 13, 2009 in its version of the Interlocal <br />Agreement. The Town Board considered the BOCC-approved version of the Agreement at its <br />October 12, 2009 meeting. However, the Town Board declined to adopt the BOCC-approved <br />version of the Agreement. <br />The language the Town Board declined to include in the Agreement is found in Sections 2.3 <br />and 3.2 of the BOCC-approved version of the Agreement (see Attachment 1). The inclusion of <br />this language would have: <br />• Ensured properties in the Orange County Urbanizing Area (orange areas on map) are <br />developed under Orange County standards (jointly developed for this area) prior to <br />annexation into the Town of Hillsborough, and <br />• Ensured Orange County Urbanizing Area representation on the Hillsborough Planning <br />Board and Board of Adjustment. <br />However, Town staff and, ultimately, the Town Board were uncomfortable with this language <br />and its impact on existing Town processes. At this time, County staff has re-evaluated the <br />language and, although it would have been beneficial to the County to include the language, is <br />comfortable with omitting the language from the Agreement in the interest of getting an <br />
