Gordon, Barry Jacobs, Pam Hemminger, Bernadette Pelissier, and Steve Yuhasz <br />16 COUNTY COMMISSIONERS ABSENT: Mike Nelson <br />17 COUNTY ATTORNEY PRESENT: John Roberts <br />18 COUNTY STAFF PRESENT: Assistant County Manager Willie Best and Deputy Clerk to the <br />19 Board David Hunt (All other staff members will be identified appropriately below) <br />20 PLANNING BOARD MEMBERS PRESENT: Chair Brian L. Zoning Ordinance Amendment: To receive public comment on proposed amendments to <br />29 Article Six (6) Application of Dimensional Requirements Section 6.23.1 Land Use Restrictions <br />30 to modify existing regulations prohibiting non-residential development within the University <br />31 Lake Critical and Protected, Cane Creek Critical, and Upper Eno Critical Watershed Protection <br />32 Overlay Districts. <br />33 <br />34 AGENDA ITEM: C3 <br />35 PUBLIC HEARING <br />36 Review of a proposal to amend <br />37 Section 6.23.1 of the Zoning Ordinance <br />38 to modify existing regulations prohibiting non-residential development within certain Protected and <br />39 Critical Watershed Overlay Districts <br />40 <br />41 ISSUE: <br />42 Section 6.23.1 prohibits non-residential development within the University Protected and Critical, <br />43 Cane Creek Critical, and Upper Eno Critical Watershed Overlay Districts, <br />44 Staff has determined that the majority of the Cedar Grove Rural Community Activity Node is <br />45 located within the Upper Eno Critical Watershed Overlay District, <br />46 As a result the development potential of this Node is limited, <br />47 <br />48 STAFF COMMENT: <br />49 Staff does not believe it was the intent of the County to outright prohibit non-residential <br />50 developments within established Nodes when it adopted the Watershed Overlay Districts in the <br />51 late 1980's and early 1990's. <br />
