This subsection 16(d) of this EMS <br />Service Franchise survives the termination of the <br />Franchise. <br />Section 17. Forum for Litigation <br />Any litigation between the Grantor and Grantee arising <br />under or regarding the Franchise shall occur, if in the <br />North Carolina courts, in Orange County Superior Court or <br />District Court having jurisdiction thereof, of it in the <br />federal courts, in the United States District Court for the <br />Middle District of North Carolina. <br />Section 18. Severability <br />If any Section, subsection, sentence, clause, phrase, or <br />other portion of this Franchise is, for any reason, <br />declared invalid, in whole or in .part, by any court, <br />agency, commission, legislative body, or other authority of <br />competent jurisdiction, such portion shall be deemed a <br />separate, distinct and independent portion. Such <br />declaration shall not affect the validity of the remaining <br />portions hereof, which other portions shall continue in <br />full force and effect. <br />19 <br />
