Once the county receives permission from <br />the Chapel Hill-Carrbaro School Board to convey the property, then the only legal <br />requirement would be the to see that the property remains used for public purpose. <br />There should be a provision in the deed that the land would revert back to the <br />county if it were used for other than public purpose. <br />Condition No. 2 from the School Board is, if the•land is not 'developed for --~ <br />public use in three years, it will revert to grantor. Condition Pto. 3 is the tract <br />shall not be used for private development. Condition tlo. 4 states, in case <br />Orange County should choose to divest itself of the tract within 50 .nears from <br />the date of the deed, Orange County shall, without charge, convey the property to <br />the Chapel Hill-Carrboro.Board of Education unless the Board of Education gives <br />written notice to Orange County that it does pat desire to have the property. <br />Dr. Hanes said the intent of the Board of Education was to see the property <br />be available for county-wide use so that it would not revert to Chapel Hill City <br />use. The Board of Education felt the Ghanel Hi11~Housing Authority an appropriate <br />use. <br />• Commissioner Gustaveson said he would like to have more specific wording <br />in•the county's deed to the Chapel Hill Housing P.uthority than "public purpose" <br />to assure county use rather than municipal use. <br />Commissioner Walker said, some provision should assure the property vrould <br />revert back to.the county if there were no longer a Housing Autfority or a <br />Section 8. <br />The County Manager said, if the Authority ceases to use the property <br />for other than public offices - the purpose for which the property was convened - <br />_a, <br />
