Issue: The septic system supporting the <br />residentially zoned parcel. Mr. Davis is <br />system supporting his commercial operation located on the residentially zoned parcel of property <br />and is seeking to rectify the problem. <br />Proposal: The applicant would like to rezone a portion of the aforementioned parcel of property <br />and then create a new lot, zoned NC-2, approximately one point six (1.6) acres in size to <br />accommodate the commercial building and the required septic system/repair area. <br />2. Sign Ordinance Amendment -Outdoor Advertising Signs (Billboards) <br />This a staff initiated amendment to Article Nine (9) of the Zoning Ordinance to develop language <br />outlining the County's limitations on the regulation of outdoor advertising signs (i.e. billboards). <br />Histo At the September 10, 2009 BOCC work session, staff was directed to initiate a zoning text <br />amendment to clarify regulations governing the regulation of outdoor advertising signs. Specifically, <br />staff was asked to develop language that addresses the limitations the County has regarding the <br />enforcement of billboard regulations as they relate to the findings of a recent court case. <br />Issue: For the past several years there has been a general discussion over what authority the <br />County has with respect to the regulation of outdoor advertising signs, which overlaps NC DOT <br />regulations. Based on comments from the County Attorney's office, our ability to regulate such <br />signage has been limited due to the findings of a recent court case over a similar issue in Stanley <br />County. <br />Proposal: Staff is proposing to amend the provisions of the Sign Ordinance to address our <br />limitations on the regulation of outdoor advertising signs in an effort to bring existing County <br />regulations into compliance with recent court decisions. <br />3. Telecommunication Wireless Support Structures (Towers) for BOCC to consider formally <br />enrolling certain publicly owned properties as possible tower sites within the County <br />Histo Recently, Orange County sent out a Request for Proposals to telecommunication <br />organizations and groups for the purpose of soliciting interest in forming public/private <br />partnerships to create a telecommunication network for the underserved and unserved portions <br />of rural Orange County. The program could be partially funded through the federal stimulus <br />(ARRA) grant programs. Provision of wireless broadband is also a goal in economic <br />development zones. <br />There are several potential County owned sites suitable for the development, and co-location, <br />of wireless facilities to address communication needs for various County departments (i.e. <br />emergency management, sheriff, inspections, information technology, etc) and provide <br />necessary coverage for residents who live in areas with little to no existing wireless service. <br />Issue: There needs to be formal recognition and pre-enrollment of these public sites into the <br />Master Telecommunications Plan (MTP) and a concomitant decision indicating that a proposed <br />wireless facility location would be a public necessity to the County.
