768 •- <br />Commissioner Willhoit said he felt the time when P. Scott was subdividing <br />this.:acreage should be the time to provide easement where required. He said <br />he did not understand why this would be a hardship. <br />The County Attorney said it was not a hardship and not a variance but a <br />partial width right-of-way. He said the ordinance had a separate section for <br />variances. <br />The Planning Director said the Planning Board recommended variance be granted <br />under partial width, The Cvunty Attorney said a variance is not permitted under <br />the ordinance. <br />The County Attorney said there is a provision that allows the Board to vary <br />from the 60 foot road requirement under certain conditions. <br />Commissioner Whitted said the meeting would adjourn until after lunch when <br />the Board could review the wording of the current ordinance. <br />Commissioner Whitted brought the meeting to order after lunch break. <br />Members present:' Commissioners Whitted, Willhoit and Gustaveson. <br />Commissioner Whitted said the topic under discussion before the Board adjourned <br />for lunch was Kent Scott's request for a partial width. He said the Board now had <br />a copy of the updated subdivision regulations. <br />The County Attorney said a good place to record the partial width right-of- <br />way would be the plat and P. Scott's deed. He was concerned the Board could <br />get an additional 30 .feet through Mr. Kent Scott's land in the event it was <br />necessary. <br />Commissioner Gustaveson said that would be indicated on the plat. <br />Commissioner Willhoit thought the 30 foot right-of-way should terminate on <br />Mr. Ken Scott's property. <br />Commissioner Whitted said if Mr. Barringer wanted to subdivide his property, <br />it would not be approved unless he used a 60 foot right-of-way. <br />The County Attorney said he was satisfied Mr. P. Scott would give an <br />additional 30 feet on the east side of the road if he wants to develop it. <br />Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to approve <br />the minor subdivision with a partial width right-of-way subject to a statement <br />being placed on the plat that this is a partial width right-of-way and further <br />subdivision will require creating a 60 foot easement. Vote: ayes, 3; noes, 0. <br />The County Attorney said it might be more appropriate to make a notation an <br />the plat of Kent Scott and the deed of P. Scott. <br />Agenda Item 7.16: Rezoning Request of Clarence Gates <br />The Planning Director said the Planning Board had recommended this request <br />be denied. He explained the property was in Eno Township off Palmer Grove Road <br />and Lawrence Road, a 3.2 acre tract out of 11.5 acres. He said the current zoning <br />is residential and Mr. Gates has requested general industrial zoning. He said <br />surrounding land is primarily open pasture and a mobile home park. He said an <br />A T & T line does cross the property. <br />Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to accept <br />the Planning Board's recommendation to deny Mr. Gates request for rezoning from <br />residential to general commercial. <br />Mr. Gates requested the full Board be present before voting on this motion <br />Commissioner Willhoit withdrew his motion. <br />Commissioner Whitted asked this item be placed on the third Tuesday's agenda <br />when all five members of the Board would be present. <br />
