RE~-aoor-1-o~5 ~ <br />ATTACHMENT 2 <br />NORTH CAROLINA Resolution Approving an Agreement Between Orange <br />County and Taylor Fislt Farm Regarding the Extension <br />of Water, Sewer and Electric Services Necessary to <br />ORANGE COUNTY Establish an Aquacultttre Facility <br />WHEREAS, pursuant to and in satisfaction of the requirements of North Carolina General <br />Statute 158-7.1, the Boatd of Commissioners of Orange County, following a public hearing, has <br />determined that if it contracts with Taylor Fish Farm as cwitemplated by the Agreement, Exhibit A, the <br />taxable property of the County and the business prospects of the County will increase; and <br />WHEREAS, the Board of Commissioners of Orange County has determined that the <br />Taylor Fish Farm project will result in the creation or maintenance of several jobs in the County at a wage <br />rate that exceed the living wage established by Orange County now and in the future. <br />NOW, THEREFORE, BE IT RESOL'YED by the Board of Commissioners of Orange <br />County: <br />1. The Board hereby makes the determinations atttibuted to it in Exhibit A and approves Exhibit <br />A in substantially the same form as Exhibit A to this Resolution. <br />2. The Board commits nine thousand four hundred forty-seven dollars ($9,447.00) from the <br />County's Utility Extension Fund as described in Exhibit A toward the incurred costs of <br />Taylor Fish Farm in constructing water, sewer, and electric services to its Aquaculture <br />Facility. <br />3. Officers and employees of the County ace authorized and directed to take such actions and <br />execute and deliver such documents, certificates, undertakings, agreements or other <br />instruments as they, with the advice of counsel, may deem necessary or appropriate to <br />effectuate the contemplated agreement itt Exhibit A. <br />This the day of October, 2009. <br />Valerie Foushee, Chair Donna Baker, Clerk to the Board <br />Orange County Board of Commissioners <br />
