35 <br />Definitions — Telecommunication Facilities: The following terms <br />concerning telecommunication wireless support structures as contained <br />within Article 6 and Article 8 of this Ordinance shall be defined as follows: <br />Accessory Use — A use incidental to, subordinate to, and subservient to <br />the principal use of the property. As defined in this section an accessory <br />use is a secondary use. <br />Antenna — A system of electrical conductor communications equipment <br />that transmits and /or receives electromagnetic radio signals used in the <br />provision of all types of wireless communications services. <br />Applicant — Any wireless service provider or wireless support structure <br />owner submitting an application for a wireless facility. <br />Application — A formal request, containing all necessary and required <br />documentation, submitted to Orange County to construct or modify a <br />wireless support structure or a wireless facility. <br />Board — The Orange County Board of County Commissioners. <br />Building Code — The most recently adopted or amended edition of the <br />North Carolina State Building Code. <br />Building permit — An official Orange County administrative authorization to <br />begin construction consistent with the provisions of G.S. 153A -357. <br />Collocation —The installation of new wireless facilities on previously <br />approved structures, including wireless support structures, buildings, utility <br />poles, and water tanks. <br />Commercial Impracticability or Commercially Impracticable — The inability <br />to perform an act on terms that are reasonable in commerce; the cause or <br />occurrence of which could not have been reasonably anticipated or <br />foreseen and that jeopardizes the financial efficacy of the project. The <br />inability to achieve a particular financial return on investment or profit, <br />standing alone, and for a single site, shall not deem a situation to be <br />commercially impracticable and shall not render an act or the terms of an <br />agreement commercially impractical. <br />EIA -222 — Electronics Industries Association Standard 222 (Structural <br />Standards for Steel Antenna Wireless support structures and Antenna <br />Support Structures). <br />Equipment enclosure — An enclosed structure, cabinet, or shelter used to <br />contain radio or other equipment necessary for the transmission or <br />reception of wireless communication signals. <br />
