7~4 <br />MINUTES <br />ORANGE COUNTY BOARD OF COMMISSIONERS <br />SEPTEMBER 5, 1978 <br />The Board of County Commissioners met in regular session on Tuesday, <br />September 5, 1978, at 10:00 a.m. in the Commissioners' Room of the Courthouse in <br />Hillsborough, North Carolina. <br />Members present: Commissioners Norman Walker, Donald lillhoit, Jan Pinney and <br />Norman Gustaveson. Commissioner Richard Whitted was absent at the start of the meetiz <br />In the absence of Chairman 4lhitted, Vice Chairman Gustaveson assumed the chair. <br />The agenda previously prepared for this meeting was amended by addition of the <br />following items: <br />Agenda Item No. 15: Commissioner Willhoit requested the Tax Supervisor advise <br />the Board of the probable effect the proposed legislative act relating to the tax- <br />ation of certain farm animals would have on the Orange County tax base. <br />Agenda Item No..16: A public hearing to confirm the Assessment Role for the <br />Colonial Hills Participating Paving Project. <br />Agenda Item No. 17: The Chairman be authorized to sign a contract with the State <br />to implement certain forest service programs. <br />Agenda Item No. 12: Commissioner Willhoit moved Agenda Item 12 be postponed <br />indefinitely. This motion received a second from Commissioner Walker. Vote: ayes,4; <br />noes, 0. <br />Agenda Item No. 9: Commissioner Walker moved this item be postponed. Commission ;~ <br />Willhoit requested this item not be postponed. Mrs. Josephine Barbour raised the <br />question, was it appropriate to consider Item 9 since the public had no reason to <br />suspect this item would be on the agenda at this time. <br />Mr. Lindsay Efland, a member of the County Planning Board, stated Ythat he felt <br />action by the Board of Commissioners at this time would preempt the role of the <br />Planning Board. Vice Chairman Gustaveson then stated the Board would not consider <br />Agenda Item 9 at this time. <br />Agenda Item No. 16: Vice Chairman Gustaveson called to order a public hearing <br />to confirm the assessment role prepared for the Colonial Hills Participating Project. <br />Mr. Charles King asked the question, "Why did the Board of Commissioners elect to <br />change the assessment formula from a front foot basis to an acreage basis?" Mr. <br />Paul Holder stated he felt his assessment was too high. A Mr. Ross stated he felt <br />his assessment should be calculated on a X2.00 a front foot basis rather than the <br />acreage basis actually proposed. Mr. Edward Jones also stated he felt his assess- <br />ment was too high. Vice Chairman Gustaveson responded, stating that at the initial <br />hearing a year ago, the County Attorney reviewed with the audience the method for <br />calculating these assessments, pointing out that the assessments were to be made on <br />an acreage basis. Commissioner Norman Walker suggested the assessments be re' <br />calculated on a front foot basis. Commissioner Donald Willhoit suggested this matter <br />be tabled. The Board concurred with Commissioner Willhoit's recommendation. Vice <br />Chairman Gustaveson then announced a notice would be sent to the property owners when <br />the Board decided it would act on the assessment role. <br />Agenda Item No. 10A: Mr. Ray Freeman, Erosion Control Officer, reported to the <br />Board that the developers of Pine Knob Subdivision and Stage Coach Run Subdivision <br />were in voilation of the County's erosion control ordinance. Commissioner Donald <br />Willhoit raised the question, "What control does the County have over the Town of <br />Chapel Hill and its Cedar Falls Park project and over the Chapel Hill School Board <br />and its Phillips School project?" <br />Mr. Freeman reported that these projects were exempt from the County control <br />by Section V of the ordinance which exempts projects which have State or Federal <br />financial involvement. He felt further the erosion control measures employed on <br />Phillips School project have not been too good. He was not familiar tivith the Cedar <br />Falls project of the Town of Chapel Hill. <br />
